A bill for an act

relating to public safety; requiring disclosure of chemical irritants used in certain

buildings; proposing coding for new law in Minnesota Statutes, chapter 626.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

[626.745] USE OF CHEMICAL IRRITANTS; DISCLOSURE REQUIRED.

(a) Notwithstanding any data classification under chapter 13, a law enforcement agency

or local government unit must disclose the name, product number, and total number of all

chemical irritants, smoke screens, and distraction devices deployed within a building by a

peace officer in the course of:

(1) executing a search warrant;

new text begin

(2) apprehending a criminal suspect; or

new text end

new text begin

(3) attempting to apprehend a criminal suspect.

(b) Upon request, disclosure must be made to the building owner, any tenant in the

building, any applicable insurer, and any person retained to provide cleaning or other

remediation services related to the deployment of chemical irritants, smoke screens, or

distraction devices.

(c) As used in this section, "building" has the meaning given in section 609.581,

subdivision 2.
