BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. new text begin MANDATORY ENVIRONMENTAL IMPACT STATEMENT FOR LARGE LIVESTOCK PROJECTS. new text end new text begin (a) The Environmental Quality Board must amend Minnesota Rules, part 4410.4400, to require that construction of an animal feedlot facility with a capacity of 10,000 or more animal units or the expansion of an existing animal feedlot facility to a total cumulative capacity of 10,000 or more animal units requires the preparation of an environmental impact statement. new text end new text begin (b) The commissioner may use the good-cause exemption under Minnesota Statutes, section 14.388, subdivision 1, clause (3), to adopt rules under this section, and Minnesota Statutes, section 14.386, does not apply except as provided under Minnesota Statutes, section 14.388. new text end new text begin EFFECTIVE DATE. new text end new text begin This section is effective the day following final enactment and applies to applications submitted on or after that date. new text end
