A bill for an act

relating to local government; authorizing the city of North Oaks to connect to the

sanitary sewer system of the Metropolitan Council and be included within the

Metropolitan Urban Service Area; proposing coding for new law in Minnesota

Statutes, chapter 473.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

The Metropolitan Council shall, upon an application by the city of North Oaks for a

comprehensive plan amendment or as part of the city's 2050 comprehensive plan, allow any

portion or the entirety of the city of North Oaks to be located within the Metropolitan Urban

Service Area (MUSA) and permit the connection of all property located within the MUSA

to the sanitary sewer system of the Metropolitan Council. The Metropolitan Council must

approve any such application, notwithstanding any contrary council policy, state statute, or

rule. Wastewater rates, fees, or costs for infrastructure capacity paid by the city of North

Oaks must not deviate substantially from rates, fees, or costs paid by similarly situated

MUSA communities. Nothing in this section exempts the city of North Oaks from a

permitting process otherwise required by the Minnesota Pollution Control Agency under

section 115.07, subdivision 3.

local approval, pursuant to Minnesota Statutes, section 645.023, subdivision 1, paragraph

(a).
