A bill for an act relating to transportation; requiring establishment of graffiti abatement policy; requiring a report; proposing coding for new law in Minnesota Statutes, chapter 174. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: Section 1. new text begin [174.76] GRAFFITI ABATEMENT. new text end new text begin Subdivision 1. new text end new text begin Graffiti abatement policy. new text end new text begin The commissioner of transportation must develop and implement a policy for preventing and abating graffiti on properties maintained by the Department of Transportation. new text end new text begin Subd. 2. new text end new text begin Consultation; best practices. new text end new text begin In developing the policy and identifying best practices for prevention and abatement, the commissioner must consult with organizations or individuals that have experience in successful graffiti abatement, including local governments, law enforcement, regional planning agencies, and business improvement associations. new text end new text begin Subd. 3. new text end new text begin High-priority properties. new text end new text begin The graffiti abatement policy must include a process for identifying properties that are a high priority for abatement measures, including properties that receive a high volume of graffiti-related complaints from the surrounding community, are highly visible to the public, are frequent targets of graffiti, and the commissioner deems are high priorities for other reasons. The commissioner must maintain a list of high-priority properties that includes the type of abatement measures applied to each property and the date the measures were taken. new text end new text begin Subd. 4. new text end new text begin Requirements. new text end new text begin The graffiti abatement policy must provide: new text end new text begin (1) best practices for preventing and abating graffiti; new text end new text begin (2) a process for identifying and designating high-priority properties; new text end new text begin (3) minimum time periods for abating graffiti on high-priority properties identified under subdivision 3; and new text end new text begin (4) minimum time periods for abating graffiti on other properties. new text end new text begin Subd. 5. new text end new text begin Report required. new text end new text begin By February 1, 2027, and annually thereafter, the commissioner must submit a report to the chairs and ranking minority members of the legislative committees with jurisdiction over transportation policy and finance. At a minimum, the report must: new text end new text begin (1) provide the most recent version of the graffiti abatement policy; new text end new text begin (2) include the list of high-priority properties and the measures taken to address graffiti on those properties; and new text end new text begin (3) identify areas for improvement in graffiti maintenance and challenges in making those improvements. new text end
