AN ACT TO AMEND SECTION 63-3-519, MISSISSIPPI CODE OF 1972, TO AUTHORIZE SHERIFFS AND THEIR DEPUTIES TO USE RADAR SPEED DETECTION DEVICES ON THE PUBLIC ROADS, STREETS AND HIGHWAYS FOR THE SOLE PURPOSE OF ENFORCING SPEED LIMITS WITHIN THE SPECIAL ZONES DESIGNATED IN THE VICINITY OF SCHOOLS; TO AMEND SECTION 63-3-515, MISSISSIPPI CODE OF 1972, TO REQUIRE THAT FUNDS FROM VIOLATIONS OF THE SPECIAL ZONES DESIGNATED IN THE VICINITY OF A SCHOOL SHALL BE USED BY COUNTIES FOR SCHOOL SAFETY BY FUNDING SCHOOL RESOURCE OFFICERS OR LAW ENFORCEMENT OFFICERS ASSIGNED TO SCHOOLS OR BY FUNDING SAFETY TRAINING OF SCHOOL FACULTY AND STAFF; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 12
SECTION 1. Section 63-3-519, Mississippi Code of 1972, is 13
amended as follows: 14
63-3-519. It * * * is unlawful for any person or peace 15
officer or law enforcement agency, except the Mississippi Highway 16
Safety Patrol, to purchase or use or allow to be used any type of 17
radar speed detection equipment upon any public street, road or 18
highway of this state. However, such equipment may be used: 19
(a) By municipal law enforcement officers within a 20
municipality having a population of two thousand (2,000) or more 21
according to the latest or a previous federal census upon the 22

public streets of the municipality, but in no case where the 23
latest federal census population for the municipality is less than 24
one thousand five hundred (1,500); 25
(b) By any college or university campus police force 26
within the confines of any campus wherein more than two thousand 27
(2,000) students are enrolled; 28
(c) By municipal law enforcement officers in any 29
municipality having a population in excess of fifteen thousand 30
(15,000) according to the latest federal census on federally 31
designated highways lying within the corporate limits. 32
(d) By municipal law enforcement officers upon the 33
public streets of any incorporated municipality (i) where the 34
county seat is located in the municipality and (ii) where there is 35
a public community college located in the municipality * * *; 36
(e) By the sheriff and his deputies on any public road, 37
street or highway outside the corporate limits of a municipality 38
for the sole purpose of enforcing speed limits within the special 39
zones designated in the vicinity of schools created under Section 40
63-3-515 as long as the special zone is indicated by caution 41
blinking lights. 42
The Mississippi Highway Safety Patrol shall be immediately 43
notified by municipal law enforcement of any road blockages or 44
emergencies occurring on any federally designated limited-access 45
highways lying within the corporate limits. 46

SECTION 2. Section 63-3-515, Mississippi Code of 1972, is 47
amended as follows: 48
63-3-515. (1) The boards of supervisors of counties and the 49
governing authorities of municipalities are hereby authorized to 50
adopt by order or resolution and to enforce within their 51
respective territorial boundaries the maximum legal rate of speed 52
at which a motor vehicle may be run or operated along any public 53
street, road, highway (except state-maintained highways), or 54
portion thereof in the vicinity of schools and churches, upon 55
levees and causeways and in other special zones which the board or 56
governing authorities may designate. The rate of speed so 57
established shall be determined upon the basis of an engineering 58
and traffic study. The order or resolution setting such speed 59
limits may provide that such limits are only effective during 60
specified times of the day, days of the week and months of the 61
year. 62
(2) Funds from violations of the special zones designated in 63
the vicinity of a school created under subsection (1) of this 64
section shall be used by counties for school safety by funding 65
school resource officers or law enforcement officers assigned to 66
schools or by funding safety training of school faculty and staff. 67
SECTION 3. This act shall take effect and be in force from 68
and after July 1, 2026. 69
