HOUSE BILL NO. 1055
AN ACT TO REQUIRE WIRELESS SERVICE PROVIDERS TO PROVIDE CALL 1
LOCATION INFORMATION CONCERNING A TELECOMMUNICATIONS DEVICE OF A 2
USER TO A REQUESTING LAW ENFORCEMENT AGENCY OR PUBLIC SAFETY 3
ANSWERING POINT WHEN REQUESTED FOR THE PURPOSE OF RESPONDING TO A 4
CALL FOR EMERGENCY SERVICES OR IN AN EMERGENCY SITUATION THAT 5
INVOLVES THE RISK OF DEATH OR SERIOUS PHYSICAL HARM; TO AUTHORIZE 6
WIRELESS SERVICE PROVIDERS TO ESTABLISH PROTOCOLS BY WHICH THE 7
PROVIDER VOLUNTARILY DISCLOSES CALL LOCATION INFORMATION; TO 8
PROHIBIT A CLAIM FOR RELIEF IN ANY COURT AGAINST ANY WIRELESS 9
SERVICE PROVIDER OR ANY OTHER PERSON FOR PROVIDING CALL LOCATION 10
INFORMATION IF ACTING IN GOOD FAITH UNDER THIS ACT; TO REQUIRE THE 11
DEPARTMENT OF PUBLIC SAFETY TO OBTAIN AND DISSEMINATE CONTACT 12
INFORMATION FROM ALL WIRELESS SERVICE PROVIDERS AUTHORIZED TO DO 13
BUSINESS IN THIS STATE; TO BRING FORWARD SECTION 19-5-319, 14
MISSISSIPPI CODE OF 1972, FOR THE PURPOSE OF POSSIBLE AMENDMENT; 15
AND FOR RELATED PURPOSES. 16
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 17
SECTION 1. (1) For the purposes of this section, "public 18
safety answering point" means that term as defined in Section 19
19-5-383. 20
(2) Upon request of a law enforcement agency or a public 21
safety answering point, on behalf of a law enforcement agency, a 22
wireless service provider shall provide call location information 23
concerning the telecommunications device of a user to the 24
requesting law enforcement agency or public safety answering 25

point. A law enforcement agency or public safety answering point 26
may only request information under this section for the purposes 27
of responding to a call for emergency services or in an emergency 28
situation that involves the risk of death or serious physical 29
harm. 30
(3) A wireless service provider may establish protocols by 31
which the provider voluntarily discloses call location 32
information. 33
(4) A claim for relief may not be brought in any court 34
against any wireless service provider or any other person for 35
providing call location information if acting in good faith under 36
this section. 37
(5) The Department of Public Safety shall obtain contact 38
information from all wireless service providers authorized to do 39
business in this state to facilitate a request from a law 40
enforcement agency or a public safety answering point on behalf of 41
a law enforcement agency for call location information under this 42
section. The department shall disseminate the contact information 43
to each public safety answering point in this state. 44
SECTION 2. Section 19-5-319, Mississippi Code of 1972, is 45
brought forward as follows: 46
19-5-319. (1) Automatic number identification (ANI), 47
automatic location identification (ALI) and geographic automatic 48
location identification (GeoALI) information that consist of the 49
name, address and telephone number of telephone or wireless 50

subscribers shall be confidential, and the dissemination of the 51
information contained in the 911 automatic number and location 52
database is prohibited except for the following purpose: The 53
information will be provided to the Public Safety Answering Point 54
(PSAP) on a call-by-call basis only for the purpose of handling 55
emergency calls or for training, and any permanent record of the 56
information shall be secured by the Public Safety Answering Point 57
(PSAP) and disposed of in a manner which will retain that 58
security, except upon court order or subpoena from a court of 59
competent jurisdiction or as otherwise provided by law. 60
(2) All emergency telephone calls and telephone call 61
transmissions received pursuant to Section 19-5-301 et seq., and 62
all recordings of the emergency telephone calls, shall remain 63
confidential and shall be used only for the purposes as may be 64
needed for law enforcement, fire, medical rescue or other 65
emergency services. These recordings shall not be released to any 66
other parties without court order or subpoena from a court of 67
competent jurisdiction. 68
(3) PSAP and emergency response entities shall maintain and, 69
upon request, release a record of the date of call, time of call, 70
the time the emergency response entity was notified, and the 71
identity of the emergency response entity. The emergency response 72
entity shall maintain and, upon request, release a record of the 73
date and time the call was received by the emergency response 74
entity and the time the emergency response entity arrived on the 75

scene. Requests for release of records must be made in writing 76
and must specify the information desired. Requestors shall pay 77
the cost of providing the information requested in accordance with 78
the Mississippi Public Records Act of 1983, Section 25-61-1 et 79
seq. The identity of any caller or person or persons who are the 80
subject of any call, or the address, phone number or other 81
identifying information about any such person, shall not be 82
released except as provided in subsection (2) of this section. 83
SECTION 3. This act shall take effect and be in force from 84
and after its passage. 85
