AN ACT TO REQUIRE CERTAIN DWELLING UNITS TO INSTALL FUEL GAS 1
SENSOR DEVICES; TO DEFINE CERTAIN TERMS; TO PROVIDE THAT THE STATE 2
FIRE MARSHALL SHALL PROVIDE ENFORCEMENT OF THE ACT; TO PROVIDE 3
CERTAIN PENALTIES; AND FOR RELATED PURPOSES. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 5
SECTION 1. As used under this act the following words and 6
phrases shall mean: 7
(a) "Dwelling unit" means a room or a room or group of 8
rooms within the following: 9
(i) Hotel as defined under Section 27-65-3.1; and 10
(ii) Apartment house as defined under Section 11
77-3-97. 12
(b) "Fuel gas sensor device" means a gas alarm or 13
detector that bears the label of a nationally recognized testing 14
laboratory, and has been tested and listed as complying with the 15
most recent Underwriters Laboratories Standard 2075 for Gas and 16
Vapor Detectors or Standard 1484 for Fuel Gas Alarms, or any 17
successors thereto, unless superseded by rules adopted by the 18
Commissioner of Community Affairs. The installation, location, 19

and number of fuel gas sensor devices shall conform to the 20
provisions of the current National Fire Protection Association 21
(NFPA) 715, Standard for the Installation of Fuel Gases Detection 22
and Warning Equipment, and any rules promulgated by the 23
Commissioner of Community Affairs; provided, however, that such 24
rules shall not exceed the requirements of NFPA 715 with respect 25
to the number, placement, or other locational requirements of such 26
devices. 27
SECTION 2. (1) Every dwelling unit shall be equipped with 28
one or more fuel gas sensor devices unless it is determined that 29
no potential hazard exists for a unit. Any such determination 30
shall be made in accordance with the rules promulgated by the 31
State Fire Marshall. 32
(2) Every dwelling space shall be subject to inspection by 33
the State Fire Marshall. Upon the first inspection of a dwelling 34
unit pursuant to this section, the State Fire Marshall shall 35
require the installation of one or more fuel gas sensor devices 36
within the dwelling unit if one is not present when inspected. 37
Upon any subsequent inspection, the State Fire Marshall shall 38
determine whether any existing fuel gas sensor devices within the 39
dwelling unit require replacement due to age, battery life, or 40
other functional deficiencies. Upon such a finding, the State 41
Fire Marshall shall require the immediate repair or replacement of 42
any deficient sensor devices. 43

SECTION 3. In any case where a dwelling unit is subject to a 44
municipal ordinance requiring the issuance of a certificate of 45
occupancy, certificate of inspection or other documentary 46
certification of compliance with laws and regulations relating to 47
the safety, healthfulness and upkeep of the premises, no such 48
certificate shall issue until the officer or municipal agency 49
responsible for its issuance has determined that: 50
(a) The dwelling unit is equipped with one or more fuel 51
gas sensor devices; or 52
(b) That there is no need to equip the dwelling unit 53
with a fuel gas sensor device because there is no potential for 54
fuel gas hazard in the dwelling unit. 55
Any determination that may be made as prescribed under this 56
subsection shall be made in accordance with rules adopted by the 57
State Fire Marshall. 58
SECTION 4. An owner who sells, leases or otherwise permits 59
occupancy of a dwelling unit without complying with the provisions 60
of this act shall be subject to a fine of not more than One 61
Hundred Dollars ($100.00), which may be collected and enforced by 62
the State Fire Marshall. 63
SECTION 5. This act shall take effect and be in force from 64
and after July 1, 2026. 65
