AN ACT TO AMEND SECTION 37-28-37, MISSISSIPPI CODE OF 1972, 1

OF FUNDING AND RECOMMENDED STATUTORY CHANGES TO LAWS RELATING TO 3
CHARTER SCHOOLS FROM ANNUALLY TO BIENNIALLY; AND FOR RELATED 4
PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. Section 37-28-37, Mississippi Code of 1972, is 7
amended as follows: 8
37-28-37. (1) Before October 1 of each year, beginning in 9
the year that the state has had at least one (1) charter school 10
operating for a full school year, the Mississippi Charter School 11
Authorizer Board shall issue to the Governor, Legislature, State 12
Board of Education and the public an annual report on the state's 13
charter schools for the preceding school year. The report must 14
include a comparison of the performance of charter school students 15
with the performance of academically, ethnically and economically 16
comparable groups of students in the school district in which a 17
charter school is located. In addition, the report must include 18
the authorizer's assessment of the successes, challenges and areas 19

for improvement in meeting the purposes of this chapter. The 20
report also must include an assessment on whether the number and 21
size of operating charter schools are sufficient to meet demand, 22
as calculated according to admissions data and the number of 23
students denied enrollment based on lottery results. The report 24
due from the authorizer under this section must be coordinated 25
with reports due from charter school governing boards, as near as 26
possible, to decrease or eliminate duplication. 27
(2) The Joint Legislative Committee on Performance 28
Evaluation and Expenditure Review (PEER) shall prepare * * * a 29
biennial report assessing the sufficiency of funding for charter 30
schools, the efficacy of the state formula for authorizer funding, 31
and any suggested changes in state law or policy necessary to 32
strengthen the state's charter schools. 33
SECTION 2. This act shall take effect and be in force from 34
and after July 1, 2026. 35
