AN ACT TO CREATE "TREY'S LAW" TO PROHIBIT NONDISCLOSURE 1

NONDISCLOSURE AGREEMENT, CONFIDENTIALITY AGREEMENT, EMPLOYMENT 3
AGREEMENT, SETTLEMENT AGREEMENT, OR ANY OTHER TYPE OF AGREEMENT 4
THAT PROHIBITS AN INDIVIDUAL OR ENTITY FROM DISCLOSING AN ACT OF 5
SEXUAL ABUSE OR FACTS RELATED TO AN ACT OF SEXUAL ABUSE TO ANOTHER 6
INDIVIDUAL OR ENTITY IS VOID AND UNENFORCEABLE; AND FOR RELATED 7
PURPOSES. 8
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 9
SECTION 1. This act shall be known and may be cited as 10
"Trey's Law". 11
SECTION 2. The Legislature finds and declares all of the 12
following: 13
(a) Sexual abuse causes significant and lasting harm to 14
individuals and society as a whole. 15
(b) Sexual abuse survivors often experience long-term 16
physical, psychological, and emotional trauma. 17
(c) The State of Mississippi has a compelling interest 18
in preventing sexual abuse, supporting victims, and ensuring that 19
the law does not shield perpetrators or impede public safety. 20

(d) Any agreement that prohibits an individual or 21
entity from disclosing an act of sexual abuse or facts related to 22
an act of sexual abuse is against the public policy of this state. 23
(e) This act is intended to protect survivors' rights 24
to speak freely and to maintain privacy and confidentiality 25
regarding their identities, experiences, and trauma. 26
SECTION 3. (1) (a) For the purposes of this section, the 27
term "sexual abuse" means any conduct that, if convicted, would 28
require registration as a sex offender, or be considered a crime 29
of sexual violence under state law, including human trafficking, 30
regardless of whether the conduct has led to a criminal charge, 31
conviction, adjudication, or sentence. 32
(b) Any provision of a nondisclosure agreement, 33
confidentiality agreement, employment agreement, settlement 34
agreement, or any other type of agreement that prohibits an 35
individual or entity from disclosing an act of sexual abuse or 36
facts related to an act of sexual abuse to another individual or 37
entity is void and unenforceable. 38
(2) This subsection shall apply to any agreement entered 39
into, executed, or amended on or after July 1, 2026, and shall 40
apply solely to elements of an agreement related to the act of 41
sexual abuse and shall not apply to other aspects of an agreement, 42
including, but not limited to, compensation. 43
SECTION 4. This act shall take effect and be in force from 44
and after July 1, 2026. 45
