WARRANTS IN THIS STATE, INCLUDING SERVICE AND NOTICE OF BENCH 3
WARRANTS AND TO PROPOSE LEGISLATION BASED UPON ITS FINDINGS; TO 4
DIRECT THE TASK FORCE TO MAKE RECOMMENDATIONS FOR LEGISLATION 5
AFTER ITS REVIEW OF CERTAIN ISSUES; TO PROVIDE FOR THE MEMBERSHIP 6
OF THE TASK FORCE; TO PROVIDE PROCEDURE FOR THE TASK FORCE; TO 7
REQUIRE REPRESENTATIVES OF BOTH THE ADMINISTRATIVE OFFICE OF 8

OF THE MISSISSIPPI CONVEYANCE SAFETY ACT; TO AMEND SECTION 16
37-7-203, MISSISSIPPI CODE OF 1972, TO REVISE HOW VACANCIES OF 17
SCHOOL BOARD TRUSTEES ARE FILLED; TO PROVIDE FOR THE ELECTION OF 18
SCHOOL BOARD MEMBERS OF A CERTAIN SCHOOL DISTRICT; TO AMEND 19
SECTION 25-3-9, MISSISSIPPI CODE OF 1972, TO AUTHORIZE A CERTAIN 20
COUNTY TO EMPLOY ITS ELECTED COUNTY PROSECUTING ATTORNEY ON A 21
FULL-TIME BASIS; AND FOR RELATED PURPOSES. 22
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 23
SECTION 1. (1) There is created the Mississippi Service of 24
Bench Warrants Task Force to study procedures related to the 25
issuance of bench warrants in this state, including service and 26
notice of bench warrants, and to propose legislation based upon 27
its findings. 28

(2) The task force shall make recommendations for 29
legislation, if any, after its review of the following: 30
(a) The procedure for the issuance, service and notice 31
of bench warrants in this state; 32
(b) The national trends concerning the issuance, 33
service and notice of bench warrants; 34
(c) The use of electronic transmission for service of 35
bench warrants, including feasibility of notification by means of 36
the Mississippi Electronic Courts system; 37
(d) The certificate of service and necessary proof of 38
transmission to be retained by a clerk if electronic transmission 39
of service of bench warrants is permitted; 40
(e) House Bill No. 1142, 2026 Regular Session, as 41
passed the House; 42
(f) Review any other matters related to the above 43
issues or related to bench warrants. 44
(3) The task force shall be composed of the following seven 45
(7) members: 46
(a) The Chair of the Senate Judiciary, Division B 47
Committee who shall serve as co-chair of the task force; 48
(b) The Chair of the House Judiciary B Committee who 49
shall serve as co-chair of the task force; 50
(c) The Vice Chair of the Senate Judiciary, Division B 51
Committee; 52
(d) The Vice Chair of the House Judiciary B Committee; 53

(e) One (1) circuit court judge to be appointed by the 54
Chief Justice of the Mississippi Supreme Court; 55
(f) One (1) designee of the Mississippi Circuit Clerks 56
Association to be appointed by the president of the association; 57
(g) One (1) designee of the Mississippi Bail Agents 58
Association to be appointed by the president of the association. 59
(4) The appointments to the task force shall be made within 60
thirty (30) days of the effective date of this act. The task 61
force shall meet upon the joint call of the co-chairs of the task 62
force not later than October 1, 2026. A majority of the members 63
of the task force shall constitute a quorum. A quorum shall be 64
required to approve any final report and recommendation. 65
(5) Representatives of both the Administrative Office of 66
Courts and the Mississippi Electronic Courts system shall receive 67
notice of each meeting of the task force and shall attend the 68
meetings of the task force. The Administrative Office of Courts 69
shall provide necessary clerical support for the meetings of the 70
task force and the preparation of the report. Proposed 71
legislation shall be prepared by the Legislative Services Offices 72
of the Senate and House as requested. 73
(6) The task force may request the assistance of any proper 74
section of the Mississippi Bar Association or any other 75
organization with expertise in the service of bench warrants. 76
(7) The task force shall develop and report its findings and 77
recommendations for proposed legislation to the Lieutenant 78

Governor and the Speaker of the House on or before December 1, 79
2026. Upon filing of its report, the task force shall be 80
dissolved. 81
SECTION 2. Section 37-7-203, Mississippi Code of 1972, is 82
amended as follows: 83
37-7-203. (1) Except as otherwise provided in subsections 84
(3), (4) and (5) of this section, the boards of trustees of all 85
municipal separate school districts created under this chapter, 86
either with or without added territory, shall consist of five (5) 87
members, each to be chosen for a term of five (5) years, but so 88
chosen that the term of office of one (1) member shall expire each 89
year. In the event the added territory of a municipal separate 90
school district furnishes fifteen percent (15%) or more of the 91
pupils enrolled in the schools of such district, then at least one 92
(1) member of the board of trustees of such school district shall 93
be a resident of the added territory outside the corporate limits. 94
In the event the added territory of a municipal separate school 95
district furnishes thirty percent (30%) or more of the pupils 96
enrolled in the schools of such district, then not more than two 97
(2) members of the board of trustees of such school district shall 98
be residents of the added territory outside the corporate limits. 99
In the event the added territory of a municipal separate school 100
district in a county in which Mississippi Highways 8 and 15 101
intersect furnishes thirty percent (30%) or more of the pupils 102
enrolled in the schools of such district, then the five (5) 103

members of the board of trustees of such school district shall be 104
elected at large from such school district for a term of five (5) 105
years each except that the two (2) elected trustees presently 106
serving on such board shall continue to serve for their respective 107
terms of office. The three (3) appointed trustees presently 108
serving on such board shall continue to serve until their 109
successors are elected in March of 1975 in the manner provided for 110
in Section 37-7-215. At such election, one (1) trustee shall be 111
elected for a term of two (2) years, one (1) for a term of three 112
(3) years and one (1) for a term of five (5) years. Subsequent 113
terms for each successor trustee shall be for five (5) years. In 114
the event one (1) of two (2) municipal separate school districts 115
located in any county with two (2) judicial districts, District 1 116
being comprised of Supervisors Districts 1, 2, 4 and 5, and 117
District 2 being comprised of Supervisors District 3, with added 118
territory embraces three (3) full supervisors districts of a 119
county, one (1) trustee shall be elected from each of the three 120
(3) supervisors districts outside the corporate limits of the 121
municipality. In the further event that the territory of a 122
municipal separate school district located in any county with two 123
(2) judicial districts, District 1 being comprised of Supervisors 124
Districts 1, 2, 4 and 5, and District 2 being comprised of 125
Supervisors District 3, with added territory embraces four (4) 126
full supervisors districts in the county, and in any county in 127
which a municipal separate school district embraces the entire 128

county in which Highways 14 and 15 intersect, one (1) trustee 129
shall be elected from each supervisors district. 130
Except as otherwise provided herein, the trustees of such a 131
municipal separate school district shall be elected by a majority 132
of the governing authorities of the municipality at the first 133
meeting of the governing authorities held in the month of February 134
of each year, and the term of office of the member so elected 135
shall commence on the first Saturday of March following. In the 136
case of a member of the board of trustees who is required to come 137
from the added territory outside the corporate limits as is above 138
provided, such member of the board of trustees shall be elected by 139
the qualified electors of the school district residing in such 140
added territory outside the corporate limits at the same time and 141
in the same manner as is otherwise provided in this article for 142
the election of trustees of school districts other than municipal 143
separate school districts. 144
In the event that a portion of a county school district is 145
reconstituted, in the manner provided by law, into a municipal 146
separate school district with added territory and in the event 147
that the trustees to be elected from the added territory are 148
requested to be elected from separate election districts within 149
the added territory, instead of elected at large, by the Attorney 150
General of the United States as a result of and pursuant to 151
preclearance under Section 5 of the Voting Rights Act of 1965, as 152
amended and extended, and in the event the added territory of a 153

municipal separate school district of a municipality furnishes 154
thirty percent (30%) or more of the pupils enrolled in the schools 155
of such district, then two (2) members of the board of trustees 156
shall be residents of the added territory outside the corporate 157
limits of such municipality and shall be elected from special 158
trustee election districts by the qualified electors thereof as 159
herein provided. The board of trustees of the school district 160
shall apportion the added territory into two (2) special trustee 161
election districts as nearly as possible according to population 162
and other factors heretofore pronounced by the courts. The board 163
of trustees of the school district shall thereafter publish the 164
same in a newspaper of general circulation within that school 165
district for at least two (2) consecutive weeks; and after having 166
given notice of publication and recording the same upon the 167
minutes of the board of trustees of the school district, the new 168
district lines shall thereafter be effective. Any person elected 169
from the new trustee election districts constituted herein shall 170
be elected in the manner provided for in Section 37-7-215 for a 171
term of five (5) years. Any vacancy in the office of a trustee 172
elected from such trustee election district, whether occasioned by 173
redistricting or by other cause, shall be filled by appointment of 174
the governing authorities of the municipality, provided that the 175
person so appointed shall serve only until the next general 176
election following his appointment, at which time a person shall 177

be elected for the remainder of the unexpired term in the manner 178
provided in Section 37-7-215. 179
In any county organizing a countywide municipal separate 180
school district after January 1, 1965, the trustees thereof to be 181
elected from outside the municipality, such trustees shall be 182
elected by the board of supervisors of such county, and the 183
superintendent of such school district shall have authority to pay 184
out and distribute the funds of the district. In the event a 185
municipal separate school district should occupy territory in a 186
county other than that in which the municipality is located and 187
fifteen percent (15%) or more of the pupils enrolled in the 188
schools of such district shall come from the territory of the 189
district in the county other than that in which the municipality 190
is located, the territory of such county in which the municipality 191
is not located shall be entitled to one (1) member on the board of 192
trustees of such school district. The trustee shall be a resident 193
of the territory of that part of the district lying in the county 194
in which the municipality is not located and shall be elected by 195
the qualified electors of the territory of such county at the same 196
time and in the same manner as is provided for the election of 197
trustees of school districts other than municipal separate school 198
districts having territory in two (2) or more counties. 199
All vacancies shall be filled for the unexpired terms by 200
appointment of the governing authorities of the municipality; 201
except that in the case of the trustees coming from the added 202

territory outside the corporate limits, the person so appointed 203
shall serve only until the next general election following his 204
appointment, at which time a person shall be elected for the 205
remainder of the unexpired term in the manner otherwise provided 206
herein. 207
No person who is a member of such governing body, or who is 208
an employee of the municipality, or who is a member of the county 209
board of education, or who is a trustee of any public, private or 210
sectarian school or college located in the county, inclusive of 211
the municipal separate school district, or who is a teacher in or 212
a trustee of the school district, shall be eligible for 213
appointment to the board of trustees. 214
(2) In counties of less than fifteen thousand (15,000) 215
people having a municipal separate school district with added 216
territory which embraces all the territory of a county, one or 217
more trustees of the school district shall be nominated from each 218
supervisors district upon petition of fifty (50) qualified 219
electors of that supervisors district, or twenty percent (20%) of 220
the qualified electors of such district, whichever number shall be 221
smaller. One (1) trustee must be elected from each supervisors 222
district of the county. In such counties embraced entirely by a 223
municipal separate school district, there shall be no county board 224
of education after the formation of such district, and the county 225
superintendent of education shall act as superintendent of schools 226
of the district and shall be appointed by the board of trustees of 227

that district, and the provisions of subsection (1) of this 228
section and the first paragraph of Section 37-7-211 shall not 229
apply to such districts. 230
(3) In municipalities designated as having a mayor-council 231
form of government under Chapter 8, Title 21, Mississippi Code of 232
1972, and having a population in excess of one hundred thousand 233
(100,000) according to the 2000 federal decennial census, the 234
boards of trustees of the municipal separate school district 235
located in the municipality may, if authorized by ordinance of the 236
municipal governing authority, consist of seven (7) members 237
residing in each of the seven (7) wards in the municipality, to be 238
appointed by the mayor and confirmed by the city council as 239
follows: (a) each board member shall reside in the ward from 240
which he is appointed; (b) members serving on March 31, 2010, 241
shall continue to serve until a new term commences and new members 242
shall be selected from wards not currently represented on the 243
board; (c) one (1) of the two (2) additional appointments shall 244
serve a term of five (5) years and one (1) for a term of four (4) 245
years, with all subsequent appointments for a five-year term; and 246
(d) each new appointment shall be made by the mayor and confirmed 247
by the city council of the municipality at the first meeting of 248
the governing authorities held in the month of June following 249
March 31, 2010, and thereafter each year, and the term of office 250
of each member so selected shall commence on the first Saturday of 251
July following. 252

(4) (a) Beginning in 2017, in any municipal separate school 253
district that is traversed by the Escatawpa River and in which 254
Interstate Highway 10 and Mississippi Highway 63 intersect, the 255
board of trustees of the municipal separate school district shall 256
consist of five (5) members, each to be elected for a term of four 257
(4) years in the manner provided in this subsection. Within 258
forty-five (45) days after July 1, 2017, the municipal governing 259
authority shall apportion the municipal separate school district, 260
including any added territory outside the corporate limits, into 261
five (5) special trustee election districts as nearly equal as 262
possible according to population, incumbency and other factors 263
pronounced by the courts before August 8, 2017. The municipal 264
governing authority shall place upon its minutes the boundaries 265
determined for the new five (5) trustee election districts and 266
shall publish the same in a newspaper of general circulation 267
within the school district for at least three (3) consecutive 268
weeks. After having given notice of publication and recording the 269
same upon the minutes of the municipal governing authority, the 270
new district lines shall be effective. 271
(b) On the first Tuesday after the first Monday in 272
November 2017, and every four (4) years thereafter, an election 273
shall be held in the municipal separate school district for local 274
school board members from trustee election districts 1, 3 and 5 in 275
the same manner and at the same time as the general municipal 276
election is held and conducted, for the purpose of electing the 277

board of trustees of the municipal separate school district. All 278
members of the board of trustees elected pursuant to this 279
paragraph (b) shall take office on the first Monday of January 280
immediately following the date of their election. However, in 281
order to provide for an orderly transition, the term of each 282
member of the board of trustees serving on July 1, 2017, which 283
otherwise would expire after the first Monday in July 2018, shall 284
expire on the first Monday of January 2018. If no individual 285
qualifies for the elective office of school district trustee, the 286
trustee for that specific trustee district shall be filled by 287
appointment of the municipal governing authority; however, the 288
person so appointed to fill the vacancy may serve only until the 289
first Monday in January 2019, at which time the trustee elected 290
pursuant to this subsection shall take office for the remainder of 291
the unexpired initial term. 292
From and after January 1, 2018, any vacancy on the board of 293
trustees shall be filled by appointment by the remaining members 294
of the board of trustees within sixty (60) days after the vacancy 295
occurs. The appointee must be selected from the qualified 296
electors of the trustee election district in which the vacancy 297
occurs. The appointee shall serve until the first Monday of 298
January succeeding the next general municipal election, at which 299
election a member from that trustee election district shall be 300
elected for a full term. 301

(c) On the first Tuesday after the first Monday in 302
November 2018, and every four (4) years thereafter, an election 303
shall be held in the municipal separate school district for local 304
school board members from trustee election districts 2 and 4 in 305
the same manner and at the same time as the Congressional mid-term 306
election is held and conducted, for the purpose of electing the 307
board of trustees of the municipal separate school district. All 308
members of the board of trustees elected pursuant to this 309
paragraph (c) shall take office on the first Monday of January 310
immediately following the date of their election. However, in 311
order to provide for an orderly transition, the term of each 312
member of the board of trustees serving on July 1, 2018, which 313
otherwise would expire after the first Monday in July 2018, shall 314
expire on the first Monday of January 2019. If no individual 315
qualifies for the elective office of school district trustee, the 316
trustee for that specific trustee district shall be filled by 317
appointment of the municipal governing authority; however, the 318
person so appointed to fill the vacancy may serve only until the 319
first Monday in January 2020, at which time the trustee elected 320
pursuant to this subsection shall take office for the remainder of 321
the unexpired initial term. 322
From and after July 1, 2020, any vacancy on the board of 323
trustees shall be filled by appointment by the remaining members 324
of the board of trustees within sixty (60) days after the vacancy 325
occurs. The appointee must be selected from the qualified 326

electors of the trustee election district in which the vacancy 327
occurs. The appointee shall serve until the first Monday of July 328
succeeding the next general municipal election, at which election 329
a member from that trustee election district shall be elected for 330
a full term. 331
(5) (a) Beginning in 2024, in any municipal separate school 332
district in which Interstate Highway 20 and Mississippi Highway 15 333
intersect, the board of trustees of the municipal separate school 334
district shall consist of five (5) members, each to be elected for 335
a term of four (4) years in the manner provided in this 336
subsection. Within forty-five (45) days after July 1, 2024, the 337
municipal governing authority shall apportion the municipal 338
separate school district, including any added territory outside 339
the corporate limits, into five (5) special trustee election 340
districts as nearly equal as possible according to population, 341
incumbency and other factors pronounced by the courts before 342
January 1, 2024. The municipal governing authority shall place 343
upon its minutes the boundaries determined for the new five (5) 344
trustee election districts and shall publish the same in a 345
newspaper of general circulation within the school district for at 346
least three (3) consecutive weeks. After having given notice of 347
publication and recording the same upon the minutes of the 348
municipal governing authority, the new district lines shall be 349
effective. Candidates for such positions shall file the intent to 350

be a candidate not later than 5:00 p.m. on September 1, 2024, and 351
shall qualify as otherwise provided by law. 352
(b) On the first Tuesday after the first Monday in 353
November 2024, an election shall be held in the municipal separate 354
school district for local school board members in the same manner 355
and at the same time as the presidential election is held and 356
conducted, for the purpose of electing the board of trustees of 357
the municipal separate school district. All members of the board 358
of trustees elected pursuant to this paragraph (b) shall take 359
office on the first Monday of January immediately following the 360
date of their election, and may serve until the first Monday in 361
January 2028, at which time the trustee elected pursuant to 362
paragraph (c) of this subsection shall take office. If no 363
individual qualifies for the elective office of school district 364
trustee, the trustee for that specific trustee district shall be 365
filled by appointment of the municipal governing authority; 366
however, the person so appointed to fill the vacancy may serve 367
only until the first Monday in January 2028, at which time the 368
trustee elected pursuant to paragraph (c) of this subsection shall 369
take office. 370
From and after January 1, 2028, any vacancy on the board of 371
trustees shall be filled by appointment by the remaining members 372
of the board of trustees within sixty (60) days after the vacancy 373
occurs. The appointee must be selected from the qualified 374
electors of the trustee election district in which the vacancy 375

occurs. The appointee shall serve until the first Monday of 376
January succeeding the next general election, at which election a 377
member from that trustee election district shall be elected for 378
the remainder of the unexpired term. 379
(c) On the first Tuesday after the first Monday in 380
November 2027, and every four (4) years thereafter, an election 381
shall be held in the municipal separate school district for local 382
school board members in the same manner and at the same time as 383
the general elections are held and conducted in accordance with 384
Section 23-15-193, for the purpose of electing the board of 385
trustees of the municipal separate school district. All members 386
of the board of trustees elected pursuant to this paragraph (c) 387
shall take office on the first Monday of January immediately 388
following the date of their election. 389
(6) (a) Beginning in 2026, in any municipal separate school 390
district in which United States Highway 11 and Mississippi Highway 391
26 intersect, the board of trustees of the municipal separate 392
school district shall consist of five (5) members, each to be 393
elected for a term of four (4) years in the manner provided in 394
this subsection. Within forty-five (45) days after July 1, 2026, 395
the board of supervisors in the county in which said school 396
district is located shall apportion the municipal separate school 397
district, including any added territory outside the corporate 398
limits, into five (5) trustee election places as nearly equal as 399
possible according to population, incumbency and other factors 400

deemed appropriate by the board of supervisors in the county in 401
which said school district is located for such apportionment. The 402
board of supervisors in the county in which said school district 403
is located shall place upon its minutes the boundaries determined 404
for the new five (5) trustee election districts and shall publish 405
the same in a newspaper of general circulation within the school 406
district for at least three (3) consecutive weeks. After having 407
given notice of publication and recording the same upon the 408
minutes of the board of supervisors in the county in which said 409
school district is located, the new district lines shall be 410
effective. Candidates for such positions shall file the intent to 411
be a candidate not later than 5:00 p.m. on September 1, 2026, and 412
shall qualify as otherwise provided by law. 413
(b) (i) On the first Tuesday after the first Monday in 414
November 2026, and two (2) years thereafter, an election shall be 415
held in the municipal separate school district for local school 416
board members from trustee election places 2 and 4 in the same 417
manner and at the same time as the Congressional mid-term election 418
is held and conducted, for the purpose of electing the board of 419
trustees of the municipal separate school district. All members 420
of the board of trustees elected pursuant to this paragraph (b) 421
shall take office on the first Monday of January immediately 422
following the date of their election, and may serve until the 423
first Monday in January 2029, at which time the trustee elected 424
pursuant to subparagraph (ii) of this paragraph (b) shall take 425

office. However, in order to provide for an orderly transition, 426
the term of each member of the board of trustees serving on July 427
1, 2026, which otherwise would expire after the first Monday in 428
July 2026, shall expire on the first Monday of January 2027. If 429
no individual qualifies for the elective office of school district 430
trustee, the trustee for that specific trustee place shall be 431
filled by appointment of the board of supervisors in the county in 432
which said school district is located. However, the person so 433
appointed to fill the vacancy may serve only until the first 434
Monday in January 2029, at which time the trustee elected pursuant 435
to subparagraph (ii) of this paragraph (b) shall take office. 436
From and after January 1, 2028, any vacancy on the board of 437
trustees shall be filled by appointment by the remaining members 438
of the board of trustees within sixty (60) days after the vacancy 439
occurs. The appointee must be selected from the qualified 440
electors of the trustee election place in which the vacancy 441
occurs. The appointee shall serve until the first Monday of 442
January succeeding the next general election, at which election a 443
member from that trustee election place shall be elected for the 444
remainder of the unexpired term. 445
(ii) On the first Tuesday after the first Monday 446
in November 2028, and every four (4) years thereafter, an election 447
shall be held in the municipal separate school district for local 448
school board members from trustee election places 2 and 4 in the 449
same manner and at the same time as the presidential election is 450

held and conducted in accordance with Section 23-15-193, for the 451
purpose of electing the board of trustees of the municipal 452
separate school district. All members of the board of trustees 453
elected pursuant to this subparagraph (ii) shall take office on 454
the first Monday of January immediately following the date of 455
their election. 456
(c) On the first Tuesday after the first Monday in 457
November 2026, and every four (4) years thereafter, an election 458
shall be held in the municipal separate school district for local 459
school board members from trustee election places 1, 3 and 5 in 460
the same manner and at the same time as the Congressional mid-term 461
election is held and conducted, for the purpose of electing the 462
board of trustees of the municipal separate school district. All 463
members of the board of trustees elected pursuant to this 464
paragraph (c) shall take office on the first Monday of January 465
immediately following the date of their election. If no 466
individual qualifies for the elective office of school district 467
trustee, the trustee for that specific trustee place shall be 468
filled by appointment of the board of supervisors in the county in 469
which said school district is located. 470
From and after January 1, 2028, any vacancy on the board of 471
trustees shall be filled by appointment by the remaining members 472
of the board of trustees within sixty (60) days after the vacancy 473
occurs. The appointee must be selected from the qualified 474
electors of the trustee election place in which the vacancy 475

occurs. The appointee shall serve until the first Monday of 476
January succeeding the next general election, at which election a 477

SECTION 3. Section 25-3-9, Mississippi Code of 1972, is 480
amended as follows: 481
25-3-9. (1) Except as provided in subsections (2), (3) and 482
(4) of this section, the county prosecuting attorney may receive 483
for his services an annual salary to be paid by the board of 484
supervisors as follows: 485
(a) For counties with a total population of more than 486
two hundred thousand (200,000), a salary not to exceed 487
Twenty-eight Thousand Five Hundred Dollars ($28,500.00). 488
(b) For counties with a total population of more than 489
one hundred thousand (100,000) and not more than two hundred 490
thousand (200,000), a salary not to exceed Twenty-six Thousand 491
Five Hundred Dollars ($26,500.00). 492
(c) For counties with a total population of more than 493
fifty thousand (50,000) and not more than one hundred thousand 494
(100,000), a salary not to exceed Twenty-one Thousand Seven 495
Hundred Dollars ($21,700.00). 496
(d) For counties with a total population of more than 497
thirty-five thousand (35,000) and not more than fifty thousand 498
(50,000), a salary not to exceed Twenty Thousand Four Hundred 499
Dollars ($20,400.00). 500

(e) For counties with a total population of more than 501
twenty-five thousand (25,000) and not more than thirty-five 502
thousand (35,000), a salary not to exceed Nineteen Thousand Three 503
Hundred Dollars ($19,300.00). 504
(f) For counties with a total population of more than 505
fifteen thousand (15,000) and not more than twenty-five thousand 506
(25,000), a salary not to exceed Seventeen Thousand Seven Hundred 507
Dollars ($17,700.00). 508
(g) For counties with a total population of more than 509
ten thousand (10,000) and not more than fifteen thousand (15,000), 510
a salary not to exceed Sixteen Thousand One Hundred Dollars 511
($16,100.00). 512
(h) For counties with a total population of more than 513
six thousand (6,000) and not more than ten thousand (10,000), a 514
salary not to exceed Fourteen Thousand Five Hundred Dollars 515
($14,500.00). 516
(i) For counties with a total population of six 517
thousand (6,000) or less, the board of supervisors, in its 518
discretion, may appoint a county prosecuting attorney, and it may 519
pay such county prosecuting attorney an annual salary not to 520
exceed Twelve Thousand Nine Hundred Dollars ($12,900.00). 521
In all cases of conviction there shall be taxed against the 522
convicted defendant, as an item of cost, the sum of Three Dollars 523
($3.00), which shall be turned in to the county treasury as a part 524
of the general county funds; however, the Three Dollars ($3.00) 525

shall not be taxed in any case in which it is not the specific 526
duty of the county attorney to appear and prosecute. 527
From and after October 1, 1993, in addition to the salaries 528
provided for in this subsection, the board of supervisors of any 529
county, in its discretion, may pay the county prosecuting attorney 530
an additional amount not to exceed ten percent (10%) of the 531
maximum allowable salary prescribed herein. 532
(2) In the following counties, the county prosecuting 533
attorney shall receive for his services an annual salary to be 534
paid by the board of supervisors, as follows: 535
(a) In any county bordering upon the Mississippi River 536
and having a population of not less than thirty thousand (30,000) 537
and not more than thirty-five thousand five hundred (35,500) 538
according to the federal census of 1990, and in counties having a 539
population of not more than thirty-seven thousand (37,000) 540
according to the federal census of 1990 in which Interstate 541
Highway 55 and U.S. Highway 98 intersect, the county prosecuting 542
attorney shall receive a salary equal to the justice court judge 543
of such county; and in any county wherein is located the state's 544
oldest state-supported institution of higher learning and wherein 545
Mississippi State Highways 7 and 6 intersect, the county 546
prosecuting attorney shall receive an annual salary equal to that 547
of a member of the board of supervisors of such county. 548
(b) In counties having a population in excess of fifty 549
thousand (50,000) in the 1960 federal census, wherein is located a 550

state-supported university and in which U.S. Highways 49 and 11 551
intersect, the salary of the county prosecuting attorney shall be 552
not less than Seventeen Thousand Four Hundred Dollars ($17,400.00) 553
per year. The Board of Supervisors of Forrest County, 554
Mississippi, may, in its discretion, and by agreement with the 555
county prosecuting attorney, employ the county prosecuting 556
attorney as a full-time elected official during his/her term of 557
office, designate additional duties and responsibilities of the 558
office and pay additional compensation up to, but not in excess 559
of, ninety percent (90%) of the annual compensation and salary of 560
the county court judge and the youth court judge of Forrest County 561
as authorized by law and provide a reasonable office and 562
reasonable office expenses to the county prosecuting attorney. 563
The salary authorized by this paragraph (b) for the county 564
prosecuting attorney shall be the sole and complete salary for 565
such prosecuting attorney in each county to which this paragraph 566
applies, notwithstanding any other provision of law to the 567
contrary. 568
(c) In any county wherein is housed the seat of state 569
government, wherein U.S. Highways 80 and 49 intersect, and having 570
two (2) judicial districts, the board of supervisors, in its 571
discretion, may pay the county prosecuting attorney an annual 572
salary equal to the annual salary of members of the board of 573
supervisors in the county. 574

(d) In any county which has two (2) judicial districts 575
and wherein Highway 8 and Highway 15 intersect, having a 576
population of greater than seventeen thousand (17,000), according 577
to the 1980 federal decennial census, the board of supervisors 578
shall pay the county prosecuting attorney a salary equal to that 579
of a member of the board of supervisors of such county; provided 580
that if such county prosecuting attorney is paid a sum for the 581
purpose of defraying office or secretarial expenses, then the 582
salary prescribed herein shall be reduced by that amount. 583
(e) In any county bordering the State of Tennessee and 584
in which Mississippi Highways No. 4 and 15 intersect, and having a 585
population of less than twenty thousand (20,000) in the 1970 586
federal census, the salary of the county prosecuting attorney 587
shall be no less than Six Thousand Dollars ($6,000.00). 588
(f) In any county having a population of more than 589
twenty-five thousand (25,000) and in which U.S. Highways 72 and 45 590
intersect, the salary of the county attorney shall be not less 591
than Eight Thousand Dollars ($8,000.00). 592
In addition, such county prosecuting attorney shall receive 593
the sum of One Thousand Five Hundred Dollars ($1,500.00) per month 594
for the purpose of defraying secretarial expense. 595
(g) In any county wherein I-20 and State Highway 15 596
intersect; and in any county wherein I-20 and State Highway 35 597
intersect, the salary of the county prosecuting attorney shall be 598
not less than Eight Thousand Four Hundred Dollars ($8,400.00). 599

(h) In any Class 1 county bordering on the Mississippi 600
River, lying in whole or in part within a levee district, wherein 601
U.S. Highways 82 and 61 intersect, bounded by the Sunflower River 602
and Stales Bayou, the board of supervisors, in its discretion, may 603
pay an annual salary equal to the annual salary of members of the 604
board of supervisors in the county. In addition, such county 605
prosecuting attorney shall receive the sum of One Thousand Dollars 606
($1,000.00) per month for the purpose of defraying secretarial 607
expenses. 608
(i) In any county bordering on the Gulf of Mexico 609
having two (2) judicial districts, and wherein U.S. Highways 90 610
and 49 intersect, the salary of the county prosecuting attorney 611
shall be not less than Nineteen Thousand Dollars ($19,000.00) per 612
year. The Board of Supervisors of Harrison County, Mississippi, 613
may, in its discretion, and by agreement with the county 614
prosecuting attorney, employ the county prosecuting attorney and 615
his/her assistant during his/her term of office, and designate 616
additional duties and responsibilities of the office and pay 617
additional compensation up to, but not in excess of, ninety 618
percent (90%) of the annual compensation and salary of the county 619
court judges of Harrison County as authorized by law and provide 620
adequate office space and reasonable office expenses to the county 621
prosecuting attorney and his/her assistant. The salary authorized 622
by this paragraph (i) for the county prosecuting attorney and 623
his/her assistant shall be the sole and complete salary paid by 624

the county for such prosecuting attorney and his/her assistant in 625
each county to which this paragraph applies, notwithstanding any 626
other provision of law to the contrary. 627
(j) In any county bordering on the State of Alabama, 628
having a population in excess of seventy-five thousand (75,000) 629
according to the 1980 decennial census in which is located an 630
institution of higher learning and a United States military 631
installation and which is traversed by an interstate highway, the 632
salary of the county prosecuting attorney shall not be less than 633
Twelve Thousand Dollars ($12,000.00) nor more than the amount of 634
the annual salary received by a member of the board of supervisors 635
of that county. 636
(k) In any county with a land area wherein Mississippi 637
Highways 8 and 9 intersect, the salary of the county prosecuting 638
attorney shall be not less than Eight Thousand Five Hundred 639
Dollars ($8,500.00) per year. 640
(l) In any Class 2 county wherein Mississippi Highways 641
6 and 3 intersect, the salary of the county prosecuting attorney 642
shall be not less than Twelve Thousand Dollars ($12,000.00) per 643
year nor more than the amount of the annual salary received by a 644
member of the board of supervisors of that county. 645
(m) In any county wherein Interstate Highway 55 and 646
State Highway 8 intersect, the salary of the county prosecuting 647
attorney shall be not less than Twelve Thousand Dollars 648
($12,000.00) per year. 649

(n) In any county wherein U.S. Highway 51 intersects 650
Mississippi Highway 6, and having two (2) judicial districts, the 651
salary of the county prosecuting attorney shall be not less than 652
Three Thousand Six Hundred Dollars ($3,600.00) per year. 653
(o) In any county bordering on the Alabama state line, 654
having a population of greater than fifteen thousand (15,000) 655
according to the 1970 federal decennial census, wherein U.S. 656
Highway 45 and Mississippi Highway 18 intersect, the salary of the 657
county prosecuting attorney shall be not less than Three Thousand 658
Six Hundred Dollars ($3,600.00) nor greater than that of a member 659
of the board of supervisors of such county. All prior acts, 660
orders and resolutions of the board of supervisors of such county 661
which authorized the payment of the salary in conformity with the 662
provisions of this paragraph, whether or not heretofore 663
specifically authorized by law are hereby ratified, approved and 664
confirmed. 665
(p) In any county wherein is located a state-supported 666
institution of higher learning and wherein U.S. Highway 82 and 667
Mississippi Highway 389 intersect, the board of supervisors, in 668
its discretion, may pay the county prosecuting attorney an annual 669
salary equal to the annual salary of members of the board of 670
supervisors in the county. 671
(q) In any county having two (2) judicial districts 672
wherein Mississippi Highway 32 intersects U.S. Highway 49E, the 673

salary of the county prosecuting attorney shall be not less than 674
Twelve Thousand Seven Hundred Dollars ($12,700.00). 675
(r) In any county traversed by the Natchez Trace 676
Parkway wherein U.S. Highway 45 and Mississippi Highway 4 677
intersect, the board of supervisors, in its discretion, may pay 678
the county prosecuting attorney an annual salary equal to the 679
annual salary of justice court judges in the county. 680
(s) In any county having a population of more than 681
fourteen thousand (14,000) according to the 1970 census and which 682
county is bordered on the north by the State of Tennessee and on 683
the east by the State of Alabama and in which U.S. Highway No. 72 684
and Highway No. 25 intersect, the board of supervisors, in its 685
discretion, may pay the county prosecuting attorney an annual 686
salary equal to the annual salary of justice court judges in the 687
county. 688
(t) (i) The Board of Supervisors of Madison County, in 689
its discretion, may pay the county prosecuting attorney an annual 690
salary in the amount of Twenty-eight Thousand Dollars 691
($28,000.00), if the county prosecuting attorney is not employed 692
on a full-time basis. 693
(ii) From and after October 1, 1993, in addition 694
to the salary provided for in subparagraph (i) of this paragraph, 695
the board of supervisors, in its discretion, may pay the county 696
prosecuting attorney an additional amount not to exceed ten 697
percent (10%) of the maximum allowable salary prescribed herein. 698

(iii) The Board of Supervisors of Madison County, 699
in its discretion, may employ the elected county prosecuting 700
attorney on a full-time basis during his or her term of office and 701
may pay compensation to the full-time prosecuting attorney in an 702
amount of not more than ninety percent (90%) of the annual 703
compensation and salary of the county court judges of the county 704
as authorized by law, and may provide adequate office space and 705
reasonable office expenses to the county prosecuting attorney. 706
The salary authorized by this subparagraph (iii) for the county 707
prosecuting attorney shall be the sole and complete salary paid by 708
the county for the prosecuting attorney in Madison County, 709
notwithstanding any other provisions of law to the contrary. 710
(u) In any county having a population in the 1970 711
census in excess of thirty-five thousand (35,000) and in which 712
U.S. Highways 49W and 82 intersect, and in which is located a 713
state penitentiary, the annual salary of a county prosecuting 714
attorney shall be Thirty Thousand Four Hundred Twenty Dollars 715
($30,420.00). 716
(v) In any county wherein Mississippi Highway 50 717
intersects U.S. Highway 45-Alternate, and having a population 718
greater than twenty thousand (20,000) according to the 1980 719
federal decennial census, a salary equal to that of a member of 720
the board of supervisors of such county; provided that if such 721
county prosecuting attorney is paid a sum for the purpose of 722

defraying office or secretarial expenses, then the salary 723
prescribed herein shall be reduced by that amount. 724
(w) In any county in which the 1975 assessed valuation 725
was Forty Million Seven Hundred Thirty-nine Thousand Four Hundred 726
Sixty-six Dollars ($40,739,466.00) and wherein U.S. Highway 45 and 727
Mississippi Highway 8 intersect, the salary of the county 728
prosecuting attorney shall be equal to that of a member of the 729
board of supervisors of such county. 730
(x) In any county bordering on the Mississippi River 731
having a population greater than fifty thousand (50,000) according 732
to the 1980 federal decennial census and also having a national 733
military park and national cemetery, an annual salary of 734
Twenty-five Thousand Dollars ($25,000.00) or a salary equal to 735
that of a member of the board of supervisors in such county, 736
whichever is greater. In addition, such county prosecuting 737
attorney shall receive the sum of One Thousand Dollars ($1,000.00) 738
per month for the purpose of defraying secretarial expenses. 739
(y) In any county bordering on the Alabama state line, 740
traversed by the Chickasawhay River, and wherein U.S. Highway 45 741
and U.S. Highway 84 intersect, a salary that shall be equal to the 742
annual salary of a member of the board of supervisors of such 743
county. All prior acts, orders and resolutions of the board of 744
supervisors of such county which authorize the payment of the 745
salary of the county prosecuting attorney in conformity with the 746
provisions of this section as it existed immediately prior to 747

April 12, 1985, are hereby ratified, approved, confirmed and 748
validated. 749
(z) In any county having a population greater than 750
sixty-five thousand five hundred eighty (65,580) but less than 751
sixty-five thousand five hundred ninety (65,590) according to the 752
1990 federal decennial census, wherein U.S. Highway 45 intersects 753
with Mississippi Highway 6, an annual salary equal to Thirty 754
Thousand Dollars ($30,000.00). 755
(aa) In any county where an institution of higher 756
learning is located and wherein U.S. Highway 82 and U.S. Highway 757
45 intersect, the salary of the county prosecuting attorney shall 758
be not less than that of a member of the board of supervisors in 759
such county, and the board of supervisors may, in its discretion, 760
pay such county prosecuting attorney a salary in an amount not to 761
exceed the amount of the salary of the District Attorney for the 762
Sixteenth Judicial District of Mississippi. 763
(bb) In any county having a population greater than six 764
thousand (6,000) according to the federal decennial census and 765
wherein U.S. Highway 61 and Highway 24 intersect, the board of 766
supervisors, in its discretion, may pay the county prosecuting 767
attorney an annual salary equal to the annual salary of members of 768
the board of supervisors in the county. 769
(cc) In any county having a population greater than 770
thirty-one thousand (31,000) according to the 1990 federal 771
decennial census and wherein U.S. Highway 61 and U.S. Highway 49 772

intersect, a salary of not less than the annual salary of justice 773
court judges in the county. 774
(dd) (i) The Rankin County prosecuting attorney, if 775
such person is not employed on a full-time basis, shall receive an 776
annual salary of Twenty-nine Thousand Dollars ($29,000.00). 777
(ii) The Board of Supervisors of Rankin County, in 778
its discretion, may employ the elected county prosecuting attorney 779
and an assistant on a full-time basis during his or her term of 780
office and may pay compensation to such full-time prosecuting 781
attorney in an amount of not more than ninety percent (90%) of the 782
annual compensation and salary of the county court judges of the 783
county as authorized by law, and may provide adequate office space 784
and reasonable office expenses to the county prosecuting attorney 785
and his/her assistant. The Board of Supervisors of Rankin County, 786
in its discretion, may also employ a full-time assistant county 787
prosecuting attorney and may pay such person an annual salary in 788
such amount as determined by the board of supervisors. The salary 789
authorized by this paragraph (dd)(ii) for the elected county 790
prosecuting attorney and an assistant shall be the sole and 791
complete salary paid by the county for the elected prosecuting 792
attorney and assistant in Rankin County, notwithstanding any other 793
provisions of law to the contrary. 794
(ee) In any county having a population greater than 795
eight thousand (8,000) but less than eight thousand two hundred 796
(8,200) according to the 1990 federal census, and in which U.S. 797

Highway 61 and Mississippi Highway 4 intersect, the board of 798
supervisors may, in its discretion, pay the county prosecuting 799
attorney an amount not to exceed Fourteen Thousand Dollars 800
($14,000.00), in addition to the maximum allowable salary for that 801
attorney under subsection (1), beginning on April 1, 1997. 802
(ff) In any county having a population greater than 803
thirty thousand three hundred (30,300) but less than thirty 804
thousand four hundred (30,400) according to the 1990 federal 805
census, and in which U.S. Highway 78 and Mississippi Highway 7 806
intersect, a salary of not less than the annual salary of a member 807
of the board of supervisors in such county. 808
(gg) In any county having a population greater than 809
thirteen thousand three hundred (13,300) but less than thirteen 810
thousand four hundred (13,400) according to the 1990 federal 811
census, and in which Mississippi Highway 24 and Mississippi 812
Highway 48 intersect, the board of supervisors may, in its 813
discretion, pay the county prosecuting attorney an additional 814
amount not to exceed ten percent (10%) of the maximum allowable 815
salary for that attorney under subsection (1). 816
(hh) In any county having a population greater than 817
eight thousand three hundred (8,300) but less than eight thousand 818
four hundred (8,400) according to the 1990 federal census, and in 819
which U.S. Highway 84 and U.S. Highway 98 intersect, the board of 820
supervisors may, in its discretion, pay the county prosecuting 821
attorney an additional amount not to exceed ten percent (10%) of 822

the maximum allowable salary for that attorney under subsection 823
(1). 824
(ii) (i) In any county having a population of more 825
than thirty thousand four hundred (30,400) and which is traversed 826
in whole or in part by I-59, U.S. Highways 98 and 11 and State 827
Highway 13, the annual salary of the county prosecuting attorney 828
shall be Twenty-five Thousand Dollars ($25,000.00); or 829
(ii) The board of supervisors of the county 830
described in subparagraph (i) of this paragraph, in its 831
discretion, may employ the elected county prosecuting attorney on 832
a full-time basis during his or her term of office and may pay 833
compensation to the full-time prosecuting attorney in an amount of 834
not more than ninety percent (90%) of the annual compensation and 835
salary of the County Court Judge of Lamar County as authorized by 836
law, and may provide adequate office space and reasonable office 837
expenses to the county prosecuting attorney. The salary 838
authorized herein by this subparagraph (ii) for the county 839
prosecuting attorney shall be the sole and complete salary paid by 840
the county for the prosecuting attorney in Lamar County, 841
notwithstanding any other provisions of law to the contrary. 842
(jj) In any county having a population greater than 843
twenty thousand (20,000) according to the 1990 federal census and 844
wherein U.S. Highway 78 and Mississippi Highway 25 intersect, the 845

prosecuting attorney an annual salary equal to the annual salary 847
of justice court judges in the county. 848
(kk) In any county having a population greater than 849
twelve thousand four hundred (12,400) but less than twelve 850
thousand five hundred (12,500) according to the 1990 federal 851
census, and in which U.S. Highway 84 and Mississippi Highway 27 852
intersect, the board of supervisors may, in its discretion, pay 853
the county prosecuting attorney an additional amount not to exceed 854
ten percent (10%) of the maximum allowable salary for that 855
attorney under subsection (1). 856
(ll) In any county having a population greater than 857
thirty thousand two hundred (30,200) but less than thirty thousand 858
three hundred (30,300) according to the 1990 federal census, and 859
in which U.S. Interstate 55 and Mississippi Highway 84 intersect, 860
the board of supervisors may, in its discretion, pay the county 861
prosecuting attorney an additional amount not to exceed ten 862
percent (10%) of the maximum allowable salary for that attorney 863
under subsection (1). 864
(mm) In any county on the Mississippi River levee, 865
having a population greater than forty-one thousand eight hundred 866
(41,800) but less than forty-one thousand nine hundred (41,900) 867
according to the 1990 federal census wherein U.S. Highway 61 and 868
Mississippi Highway 8 intersect, the board of supervisors, in its 869
discretion, may pay the county prosecuting attorney an annual 870
salary equal to the annual salary of members of the board of 871

supervisors in the county. In addition, the board of supervisors, 872
in its discretion, may pay the county prosecuting attorney the sum 873
of One Thousand Dollars ($1,000.00) per month for the purpose of 874
defraying secretarial expenses. 875
(nn) In any county having a population greater than 876
twenty-four thousand seven hundred (24,700) and less than 877
twenty-four thousand nine hundred (24,900) according to the 1990 878
federal census, wherein Mississippi Highways 15 and 16 intersect, 879
the board of supervisors, in its discretion, may pay the county 880
prosecuting attorney an annual salary equal to the annual salary 881
of members of the board of supervisors in the county. 882
(oo) In any county having a population greater than 883
thirty-seven thousand (37,000) but less than thirty-eight thousand 884
(38,000) according to the 1990 federal census, in which is located 885
a state supported institution of higher learning, and in which 886
U.S. Highway 82 and Mississippi Highway 7 intersect, the board of 887
supervisors may, in its discretion, pay the county prosecuting 888
attorney a salary in an amount not to exceed the amount of the 889
salary of the District Attorney for the Fourth Judicial District 890
of Mississippi. 891
(pp) In any county in which U.S. Highway 78 and 892
Mississippi Highway 15 intersect and which is traversed by the 893
Tallahatchie River, a salary equal to that of members of the board 894
of supervisors of the county, which salary shall be in addition to 895
any sums received for the purpose of defraying office or 896

secretarial expenses and sums received as youth court prosecutor 897
fees. 898
(qq) In any county bordering on the State of Tennessee 899
and the State of Arkansas, wherein Interstate Highway 55 and 900
Mississippi Highway 302 intersect, the board of supervisors, in 901
its discretion, may pay the county prosecuting attorney an annual 902
salary equal to the annual salary of justice court judges in the 903
county. 904
(rr) In any county that is traversed by the Natchez 905
Trace Parkway and in which Mississippi Highway 35 and Mississippi 906
Highway 12 intersect, the board of supervisors, in its discretion, 907
may pay the county prosecuting attorney an annual salary in the 908
amount of the annual salary of justice court judges in the county. 909
(ss) In any county in which Mississippi Highway 14 and 910
Mississippi Highway 25 intersect, the board of supervisors, in its 911
discretion, may pay the county prosecuting attorney an annual 912
salary in the amount of Twenty-two Thousand Dollars ($22,000.00). 913
(tt) In any county in which Interstate Highway 59 and 914
U.S. Highway 84 intersect, the board of supervisors, in its 915
discretion, may pay the county prosecuting attorney an annual 916
salary equal to the annual salary of members of the board of 917
supervisors in the county. 918
(uu) (i) In any county bordering on the Mississippi 919
River having a population greater than fifty thousand (50,000) 920
according to the 1980 federal decennial census and also having a 921

national military park and national cemetery, the board of 922
supervisors of the county shall pay an annual salary of 923
Twenty-five Thousand Dollars ($25,000.00) or a salary equal to 924
that of a member of the board of supervisors, whichever is 925
greater, if not employed on a full-time basis. In addition, the 926
county prosecuting attorney shall be paid the sum of One Thousand 927
Dollars ($1,000.00) per month for the purpose of defraying 928
secretarial expenses, if not employed on a full-time basis; or 929
(ii) The board of supervisors of the county 930
described in subparagraph (i) of this paragraph, in its 931
discretion, may employ the elected county prosecuting attorney on 932
a full-time basis during his or her term of office and may pay 933
compensation to the full-time prosecuting attorney in an amount of 934
not more than ninety percent (90%) of the annual compensation and 935
salary of the County Court Judge of Warren County as authorized by 936
law, and may provide adequate office space and reasonable office 937
expenses to the county prosecuting attorney. The salary 938
authorized herein by this subparagraph (ii) for the county 939
prosecuting attorney shall be the sole and complete salary paid by 940
the county for the prosecuting attorney in Warren County, 941
notwithstanding any other provisions of law to the contrary. 942
(3) In any case where a salary, expense allowance or other 943
sum is authorized or paid by the board of supervisors pursuant to 944
this section, that salary, expense allowance or other sum shall 945

not be reduced or terminated during the term for which the county 946
attorney was elected. 947
(4) Notwithstanding any provision of this section to the 948
contrary, no county prosecuting attorney shall receive for his 949
services an annual salary less than the salary paid to a justice 950
court judge in his respective county. 951
SECTION 4. This act shall take effect and be in force from 952
and after July 1, 2026. 953
