AN ACT TO REQUIRE THE DEPARTMENT OF MENTAL HEALTH TO 1

STABILIZATION UNIT FACILITIES; TO CREATE A SPECIAL FUND IN THE 7
STATE TREASURY TO BE DESIGNATED AS THE "CRISIS STABILIZATION UNIT 8
FACILITIES FUND"; AND FOR RELATED PURPOSES. 9
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 10
SECTION 1. (1) The Department of Mental Health shall 11
establish a program to make grants to regional commissions 12
established under Section 41-19-33, counties and municipalities 13
for the purpose of assisting in paying costs associated with (a) 14
services provided by crisis stabilization units, (b) expenses of 15
operating crisis stabilization unit facilities and (c) repairing, 16
renovating, upgrading and improving crisis stabilization unit 17
facilities. The maximum amount of a grant made to a regional 18
commission, county or municipality for a single project during a 19
fiscal year cannot exceed Five Hundred Thousand Dollars 20
($500,000.00). A regional commission, county or municipality may 21

apply to the Department of Mental Health for a grant under this 22
section in the manner provided for in this section. 23
(2) A regional commission, county or municipality desiring a 24
grant under this section must submit an application to the 25
Department of Mental Health. The application must include a 26
description of the purpose for which the grant is requested, the 27
cost of the purpose for which the grant is requested, the amount 28
of the grant requested, funds from any other sources that are 29
available for such purpose and any other information required by 30
the department. 31
(3) There is hereby created in the State Treasury a special 32
fund to be designated as the "Crisis Stabilization Unit Facilities 33
Fund", which shall consist of funds made available by the 34
Legislature in any manner and funds from any other source 35
designated for deposit into such fund. Unexpended amounts 36
remaining in the fund at the end of a fiscal year shall not lapse 37
into the State General Fund, and any investment earnings or 38
interest earned on amounts in the fund shall be deposited to the 39
credit of the fund. Monies in the fund shall be used by the 40
Department of Mental Health, upon appropriation by the 41
Legislature, for the purposes provided in this section. 42
(4) The Department of Mental Health shall have all powers 43
necessary to implement and administer the program established 44
under this section, and the department shall promulgate rules and 45

regulations, in accordance with the Mississippi Administrative 46
Procedures Law, necessary for the implementation of this section. 47
SECTION 2. This act shall take effect and be in force from 48
and after July 1, 2026. 49
