AN ACT TO PROVIDE FOR A SPECIAL ELECTION TO BE HELD IN THE NORTH TIPPAH SCHOOL DISTRICT ON THE QUESTION OF THE CLOSING OF FALKNER ATTENDANCE CENTER; TO PROVIDE THAT THE SPECIAL ELECTION SHALL BE HELD AT THE SAME TIME AND IN THE SAME MANNER AS THE GENERAL ELECTION HELD ON NOVEMBER 3, 2026; TO PROVIDE THAT IF A MAJORITY OF THE QUALIFIED ELECTORS VOTE "NO" ON THE QUESTION, THEN THE BOARD OF EDUCATION OF THE NORTH TIPPAH SCHOOL DISTRICT SHALL NOT CLOSE FALKNER ATTENDANCE CENTER, AND SHALL NOT PROPOSE TO CLOSE FALKNER ATTENDANCE CENTER AT ANY TIME DURING THE NEXT EIGHT SCHOOL YEARS; TO AMEND SECTION 37-65-101, MISSISSIPPI CODE OF 1972, TO CONFORM TO THE PRECEDING PROVISION; AND FOR RELATED PURPOSES.

AN ACT TO PROVIDE FOR A SPECIAL ELECTION TO BE HELD IN THE 1
NORTH TIPPAH SCHOOL DISTRICT ON THE QUESTION OF THE CLOSING OF 2
FALKNER ATTENDANCE CENTER; TO PROVIDE THAT THE SPECIAL ELECTION 3
SHALL BE HELD AT THE SAME TIME AND IN THE SAME MANNER AS THE 4
GENERAL ELECTION HELD ON NOVEMBER 3, 2026; TO PROVIDE THAT IF A 5
MAJORITY OF THE QUALIFIED ELECTORS VOTE "NO" ON THE QUESTION, THEN 6
THE BOARD OF EDUCATION OF THE NORTH TIPPAH SCHOOL DISTRICT SHALL 7
NOT CLOSE FALKNER ATTENDANCE CENTER, AND SHALL NOT PROPOSE TO 8
CLOSE FALKNER ATTENDANCE CENTER AT ANY TIME DURING THE NEXT EIGHT 9
SCHOOL YEARS; TO AMEND SECTION 37-65-101, MISSISSIPPI CODE OF 10
1972, TO CONFORM TO THE PRECEDING PROVISION; AND FOR RELATED 11
PURPOSES. 12
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 13
SECTION 1. There shall be a special election held in the 14
North Tippah School District on the question of the closing of 15
Falkner Attendance Center. The special election shall be held at 16
the same time and in the same manner as the general election held 17
on November 3, 2026. The question on the ballot shall be "May the 18
Board of Education of the North Tippah School District close 19
Falkner Attendance Center?" At the election, all qualified 20
electors who reside in the North Tippah School District may vote 21
on the question. If a majority of the qualified electors vote 22
"Yes" on the question, then the Board of Education of the North 23

Tippah School District may close Falkner Attendance Center. If a 24
majority of the qualified electors vote "No" on the question, then 25
the Board of Education of the North Tippah School District shall 26
not close Falkner Attendance Center, and shall not propose to 27
close Falkner Attendance Center at any time during the next eight 28
(8) school years. 29
SECTION 2. Section 37-65-101, Mississippi Code of 1972, is 30
amended as follows: 31
37-65-101. In addition to all other power and authority 32
which may now be vested in any board of trustees of any school 33
district by the constitution or statutes, or both, of the State of 34
Mississippi, any such board of trustees is * * * vested with the 35
authority to close any one or more or all schools in any school 36
district when, in its discretion, it determines such closure to be 37
to the best interest of a majority of the educable children of the 38
territory served, or to the best interest of a majority of the 39
children enrolled in any such school or schools, unless such 40
closure is otherwise prohibited by law. * * * The board of 41
trustees is also vested with the authority, in its discretion, to 42
close any one or more or all schools in any school district when 43
such board, in its discretion, determines such closure will 44
promote or preserve the public peace, order or tranquility of the 45
district. 46
SECTION 3. This act shall take effect and be in force from 47
and after July 1, 2026. 48
