BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 10
SECTION 1. Section 63-17-76, Mississippi Code of 1972, is 11
amended as follows: 12
63-17-76. (1) Every application for the issuance and 13
renewal of a used motor vehicle dealer's license shall be 14
accompanied by such evidence as the * * * Department of Revenue 15
shall prescribe, documenting the completion of an education 16
seminar conducted by the Mississippi Independent Auto Dealers 17
Association during the twelve-month period immediately preceding 18
the date of application. Completion of an eight-hour licensing 19
seminar conducted by the Mississippi Independent Auto Dealers 20
Association shall be required for an initial license. The 21

Department of Revenue in coordination with the Mississippi 22
Independent Auto Dealers Association shall determine the number of 23
continuing education hours required for an individual renewing an 24
application for a used motor vehicle dealer's license. All 25
seminars must be approved by the * * * Department of Revenue. The 26
education requirements of this section shall not apply to: 27
* * * 28
( * * *a) A manufactured home dealer; or 29
( * * *b) A franchised new car dealer licensed under 30
the Mississippi Motor Vehicle Commission Law or any employee of 31
such a dealer. 32
(2) The Mississippi Independent Auto Dealers Association 33
shall submit to the * * * Department of Revenue a complete and 34
specific description of the seminars it conducts pursuant to this 35
section, a description of how the seminar will benefit licensees 36
in conducting their businesses, the number of hours involved, a 37
description of the method which will be used to ensure attendance, 38
and copies of any instructional materials which will be provided 39
to attendees. At the time approval is granted, the * * * 40
Department of Revenue shall determine how many hours of education 41
may be received by attending the program. 42
SECTION 2. This act shall take effect and be in force from 43
and after July 1, 2026. 44
