AN ACT TO BRING FORWARD SECTIONS 77-3-801, 77-3-803, 1
77-3-805, 77-3-807 AND 77-3-809, MISSISSIPPI CODE OF 1972, WHICH 2
CREATE THE ANTI-SPOOFING ACT, FOR PURPOSES OF AMENDMENT; AND FOR 3
RELATED PURPOSES. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 5
SECTION 1. Section 77-3-801, Mississippi Code of 1972, is 6
brought forward as follows: 7
77-3-801. This article may be cited as the "Caller ID 8
Anti-Spoofing Act." 9
SECTION 2. Section 77-3-803, Mississippi Code of 1972, is 10
brought forward as follows: 11
77-3-803. As used in this article: 12
(a) "Automatic number identification" means a system 13
that identifies the billing account for a call and includes an 14
enhanced 911 service capability that enables the automatic display 15
of the ten-digit number used to place a 911 call from a wire line, 16
wireless, interconnected VoIP or nontraditional telephone service. 17
(b) "Caller identification information" means 18
information provided by a caller identification service regarding 19

the telephone number, or other origination information, of a call 20
or facsimile transmission made using a telecommunications service 21
or an interconnected VoIP service, or of a text message sent using 22
a text-messaging service. 23
(c) "Caller identification service" means any service 24
or device designed to provide the user of the service or device 25
with the telephone number of, or other information regarding the 26
origination of, a call made using a telecommunications service or 27
interconnected VoIP service. The term includes automatic number 28
identification services. 29
(d) "Interconnected VoIP service" means an 30
interconnected Voice over Internet Protocol service that: 31
(i) Enables real-time, two-way voice 32
communications; 33
(ii) Requires a broadband Internet connection from 34
the user's location; 35
(iii) Requires Internet protocol-compatible 36
customer premises equipment; and 37
(iv) Permits users generally to receive calls that 38
originate on the public switched telephone network and to 39
terminate calls to the public switched telephone network. 40
(e) "Place of primary use" means the street address 41
where a subscriber's use of a telecommunications service or 42
interconnected VoIP service primarily occurs, which shall be: 43

(i) The residential street address or the primary 44
business street address of the subscriber or, in the case of a 45
subscriber of interconnected VoIP service, the subscriber's 46
registered location; and 47
(ii) Within the licensed service area of the 48
provider. 49
(f) "Provider" means a person or entity that offers 50
telecommunications service or interconnected VoIP service. 51
(g) "Registered location" means the most recent 52
information obtained by an interconnected VoIP service provider 53
that identifies the physical location of an end user. 54
(h) "Subscriber" means a person: 55
(i) Who subscribes to a caller identification 56
service in connection with a telecommunications service or an 57
interconnected VoIP service; and 58
(ii) Whose place of primary use for the service 59
described in paragraph (h)(i) is located in Mississippi. 60
(i) "Telecommunications service" means the offering of 61
telecommunications for a fee directly to the public, or to classes 62
of users so as to be effectively available directly to the public, 63
regardless of the facilities used. 64
SECTION 3. Section 77-3-805, Mississippi Code of 1972, is 65
brought forward as follows: 66
77-3-805. Except as provided in Section 77-3-807, a person 67
shall not, in connection with any telecommunications service or 68

interconnected VoIP service, knowingly and with the intent to 69
defraud or cause harm to another person or to wrongfully obtain 70
anything of value, cause any caller identification service to 71
transmit misleading or inaccurate caller identification 72
information to a subscriber. 73
SECTION 4. Section 77-3-807, Mississippi Code of 1972, is 74
brought forward as follows: 75
77-3-807. This article does not apply to: 76
(a) The blocking of caller identification information. 77
(b) Any law enforcement agency of the federal, state, 78
county or municipal government. 79
(c) Any intelligence or security agency of the federal 80
government. 81
(d) A telecommunications, broadband or 82
voice-over-Internet service provider that is acting solely as an 83
intermediary for the transmission of telephone service between the 84
caller and the recipient. 85
SECTION 5. Section 77-3-809, Mississippi Code of 1972, is 86
brought forward as follows: 87
77-3-809. (1) Any person who violates this article shall be 88
guilty of a misdemeanor and, upon conviction thereof, shall be 89
subject to a fine of not more than One Thousand Dollars 90
($1,000.00) or shall be imprisoned in the county jail not 91
exceeding one (1) year, or both. 92

(2) Any violation of this article constitutes an unlawful 93
trade practice under Section 75-24-5 and, in addition to any 94
remedies or penalties set forth in this article, shall be subject 95
to any remedies or penalties available for a violation of that 96
statute. 97
(3) Any violation of this article constitutes a violation of 98
the Mississippi Telephone Solicitation Act, Section 77-3-701 et 99
seq., and in addition to any remedies or penalties provided in 100
this article, shall be subject to any remedies or penalties 101
available for a violation of that act. 102
SECTION 6. This act shall take effect and be in force from 103
and after July 1, 2026. 104
