HOUSE BILL NO. 1332
AN ACT TO AMEND SECTION 83-17-59, MISSISSIPPI CODE OF 1972, 1
TO REQUIRE AN OUTSIDE TESTING SERVICE UNDER CONTRACT WITH THE 2
COMMISSIONER OF INSURANCE TO ADMINISTER EXAMINATIONS FOR AN 3
INSURANCE PRODUCER LICENSE TO ADHERE TO THE STANDARDS AND BEST 4
PRACTICES SET FORTH BY THE NATIONAL ASSOCIATION OF INSURANCE 5
COMMISSIONERS; AND FOR RELATED PURPOSES. 6
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 7
SECTION 1. Section 83-17-59, Mississippi Code of 1972, is 8
amended as follows: 9
83-17-59. (1) A resident individual applying for an 10
insurance producer license shall pass a written examination unless 11
exempt under Section 83-17-67 or Section 83-17-39. The 12
examination shall test the knowledge of the individual concerning 13
the lines of authority for which application is made, the duties 14
and responsibilities of an insurance producer and the insurance 15
laws and regulations of this state. Examinations required by this 16
section shall be developed and conducted under rules and 17
regulations prescribed by the commissioner. 18
(2) The commissioner may make arrangements, including 19
contracting with an outside testing service, for administering 20

examinations and collecting a nonrefundable examination fee. A 21
testing service under contract to administer examination services, 22
as authorized under this subsection, must develop, administer and 23
score the examinations in accordance with the standards and best 24
practices developed and set forth by the National Association of 25
Insurance Commissioners. 26
(3) Each individual applying for an examination shall remit 27
a nonrefundable fee as prescribed by the commissioner. 28
(4) An individual who fails to appear for the examination as 29
scheduled or fails to pass the examination shall reapply for an 30
examination and remit all required fees and forms before being 31
rescheduled for another examination. 32
SECTION 2. This act shall take effect and be in force from 33
and after July 1, 2026. 34
