AN ACT TO AMEND SECTION 41-57-21, MISSISSIPPI CODE OF 1972, TO PROHIBIT THE STATE REGISTRAR OF VITAL RECORDS FROM CHANGING THE SEX ON A BIRTH CERTIFICATE UNLESS IT IS CLEARLY AN ERROR THAT IS VERIFIED BY MEDICAL RECORDS FROM THE TIME OF BIRTH OR BY A PHYSICIAN WHO CONFIRMS THAT AT THE TIME OF BIRTH, THE SEX OF THE CHILD WAS NOT WHAT IS SHOWN ON THE BIRTH CERTIFICATE; AND FOR RELATED PURPOSES.

AN ACT TO AMEND SECTION 41-57-21, MISSISSIPPI CODE OF 1972, 1
TO PROHIBIT THE STATE REGISTRAR OF VITAL RECORDS FROM CHANGING THE 2
SEX ON A BIRTH CERTIFICATE UNLESS IT IS CLEARLY AN ERROR THAT IS 3
VERIFIED BY MEDICAL RECORDS FROM THE TIME OF BIRTH OR BY A 4
PHYSICIAN WHO CONFIRMS THAT AT THE TIME OF BIRTH, THE SEX OF THE 5
CHILD WAS NOT WHAT IS SHOWN ON THE BIRTH CERTIFICATE; AND FOR 6
RELATED PURPOSES. 7
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 8
SECTION 1. Section 41-57-21, Mississippi Code of 1972, is 9
amended as follows: 10
41-57-21. Where there has been a bona fide effort to 11
register a birth and the certificate thereof on file with the 12
Office of Vital Records does not divulge all of the information 13
required by * * * the certificate, or such certificate contains an 14
incorrect first name, middle name, or sex, then the State 15
Registrar of Vital Records may, in his discretion, correct such 16
certificate upon affidavit of at least two (2) reputable persons 17
having personal knowledge of the facts in relation thereto. All 18
other alterations shall be made as provided in Section 41-57-23. 19
Anyone giving false information in such affidavit shall be subject 20

to the penalties of perjury. The State Registrar of Vital Records 21
shall not be authorized to change the sex on a birth certificate 22
unless it is clearly an error that is verified by medical records 23
from the time of birth or by a physician who confirms that at the 24
time of birth, the sex of the child was not what is shown on the 25
birth certificate. 26
SECTION 2. This act shall take effect and be in force from 27
and after July 1, 2026. 28
