HOUSE BILL NO. 1377

AN ACT TO AMEND SECTION 19-5-171, MISSISSIPPI CODE OF 1972, 1
TO INCREASE THE COMPENSATION FOR THE COMMISSIONERS OF THE CLEARY 2
WATER, SEWER AND FIRE DISTRICT; AND FOR RELATED PURPOSES. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 4
SECTION 1. Section 19-5-171, Mississippi Code of 1972, is 5
amended as follows: 6
19-5-171. (1) Every resident citizen of the county in which 7
is located any district created under Sections 19-5-151 through 8
19-5-207, of good reputation, being the owner of land or the 9
conductor of a business situated within the district and being 10
over twenty-five (25) years of age and of sound mind and judgment, 11
shall be eligible to hold the office of commissioner. 12
(2) Except as provided in Section 19-5-164(3), each person 13
appointed or elected as a commissioner, before entering upon the 14
discharge of the duties of the person's office, shall be required 15
to execute a bond payable to the State of Mississippi in the penal 16
sum of not less than Fifty Thousand Dollars ($50,000.00) 17
conditioned that the person will faithfully discharge the duties 18

of the office. Each bond shall be approved by the clerk of the 19
board of supervisors and filed with the clerk. 20
(3) Each commissioner shall take and subscribe to an oath of 21
office prescribed in Section 268, Mississippi Constitution of 22
1890, before the clerk of the board of supervisors that the person 23
will faithfully discharge the duties of the office of 24
commissioner, which oath shall also be filed with the clerk and 25
preserved with the official bond. 26
(4) Except as provided in subsection (5), the commissioners 27
so appointed or elected and qualified shall be compensated for 28
their services for each meeting of the board of commissioners 29
attended, either regular or special, at a rate to be fixed by the 30
board of supervisors, not to exceed the rate established in 31
Section 25-3-69 for officers of state boards, commissions and 32
agencies, and shall be reimbursed for all expenses necessarily 33
incurred in the discharge of their official duties in accordance 34
with Section 25-3-41. However, in no one (1) calendar year shall 35
any commissioner be compensated for more than twenty-four (24) 36
meetings. 37
(5) (a) The commissioners of the Hancock County Water and 38
Sewer District shall be compensated for their services at a rate 39
up to Eighty-four Dollars ($84.00) per day for each meeting of the 40
board of commissioners attended, either regular or special, and 41
shall be reimbursed for all expenses necessarily incurred in the 42

discharge of their official duties in accordance with Section 43
25-3-41. 44
(b) The commissioners of the Kiln Utility and Fire 45
District of Hancock County shall be compensated for their services 46
at a rate up to Eighty-four Dollars ($84.00) per day for each 47
meeting of the board of commissioners attended, either regular or 48
special, and shall be reimbursed for all expenses necessarily 49
incurred in the discharge of their official duties in accordance 50
with Section 25-3-41. 51
(c) The commissioners of the Pearlington Water and 52
Sewer District of Hancock County shall be compensated for their 53
services at a rate up to Eighty-four Dollars ($84.00) per day for 54
each meeting of the board of commissioners attended, either 55
regular or special, and shall be reimbursed for all expenses 56
necessarily incurred in the discharge of their official duties in 57
accordance with Section 25-3-41. 58
(d) The commissioners of the Diamondhead Water and 59
Sewer District of Hancock County shall be compensated for their 60
services at a rate up to Eighty-four Dollars ($84.00) per day for 61
each meeting of the board of commissioners attended, either 62
regular or special, and shall be reimbursed for all expenses 63
necessarily incurred in the discharge of their official duties in 64
accordance with Section 25-3-41. 65
(e) The commissioners of the Hancock County Solid Waste 66
Authority shall be compensated for their services at a rate up to 67

Eighty-four Dollars ($84.00) per day for each meeting of the board 68
of commissioners attended, either regular or special, and shall be 69
reimbursed for all expenses necessarily incurred in the discharge 70
of their official duties in accordance with Section 25-3-41. 71
(f) The commissioners of the Cleary Water, Sewer and 72
Fire District shall be compensated for their services at a rate up 73
to Eighty-four Dollars ($84.00) per day for each meeting of the 74
board of commissioners attended, either regular or special, and 75
shall be reimbursed for all expenses necessarily incurred in the 76
discharge of their official duties in accordance with Section 77
25-3-41. 78
SECTION 2. This act shall take effect and be in force from 79
and after July 1, 2026. 80
