AN ACT TO CREATE A STUDY COMMITTEE TO STUDY AND MAKE 1
RECOMMENDATIONS REGARDING THE EFFICIENT MANAGEMENT AND REGULATION 2
OF STATE-OWNED TIDELANDS AND SUBMERGED LANDS, THE DETERMINATION OF 3
RENTS, AND RENT-FREE USES OF THOSE LANDS; AND FOR RELATED 4
PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. (1) There is created a study committee for the 7
purpose of studying and recommending solutions regarding the 8
efficient management and regulation of state-owned tidelands and 9
submerged lands, the determination of rents, and rent-free uses of 10
those lands. 11
(2) The study committee shall be comprised of the following 12
nine (9) members: 13
(a) Two (2) members of the Senate, to be appointed by 14
the Lieutenant Governor; 15
(b) Two (2) members of the House of Representatives, to 16
be appointed by the Speaker of the House; 17

(c) One (1) elected municipal official representing a 18
municipality on the coast with a population of fewer than fifteen 19
thousand (15,000), to be appointed by the Lieutenant Governor; 20
(d) One (1) elected municipal official representing a 21
municipality on the coast with a population of fifteen thousand 22
(15,000) or more, to be appointed by the Speaker of the House of 23
Representatives; 24
(e) One (1) private sector member representing the 25
gaming industry in Mississippi, to be appointed by the Secretary 26
of State; 27
(f) One (1) private sector member representing the 28
small business community in Mississippi, to be appointed by the 29
Secretary of State; and 30
(g) The Secretary of State or the Secretary's designee. 31
(2) Appointments to the study committee must be made within 32
thirty (30) days of the effective date of this act. No earlier 33
than thirty (30) days after the period for making appointments, 34
the Secretary of State shall convene the members of the study 35
committee for its first meeting, at which the committee shall 36
organize by electing from among its membership a chair, a vice 37
chair and any other officers determined to be necessary. At its 38
first meeting, the committee also shall adopt rules for 39
transacting business and keeping records at its first meeting. 40
Notice of all meetings must be provided to the members of the 41

study committee no later than ten (10) days before a scheduled 42
meeting. 43
(3) A majority of the members of the study committee 44
constitutes a quorum. In the adoption of rules, resolutions and 45
reports, and in the election of a chair, vice chair and any other 46
officers determined to be necessary, an affirmative vote of a 47
majority of the members present is required. 48
(4) The Secretary of State shall provide the staff and other 49
support necessary for the study committee to perform its duties. 50
(5) For attending meetings of the committee, each 51
legislative member shall be paid from the contingent expense fund 52
of the member's respective house per diem in the amount authorized 53
under Section 25-3-69 and a mileage allowance and an expense 54
allowance in the amount authorized under Section 5-1-47. However, 55
a per diem, mileage allowance and expense allowance may not be 56
paid to legislative members of the committee while the Legislature 57
is in session or without prior approval of the proper committee of 58
the member's house when the Legislature is not in session. 59
Nonlegislative members of the committee must be paid per diem as 60
authorized under Section 25-3-69 and reimbursed for traveling 61
expenses and mileage as authorized under Section 25-3-41. 62
(6) To effectuate the purposes of this act, any department, 63
division, board, bureau, committee, institution or agency of the 64
state, or any political subdivision of the state, shall provide, 65
at the request of the chair of the study committee, the 66

facilities, assistance, information and data needed to enable the 67
study committee to carry out its duties. 68
(7) The study committee shall prepare and submit a report 69
detailing its findings and making any recommendations to the 70
Legislature before December 1, 2026. 71
(8) The study committee shall be dissolved on or before 72
January 1, 2027. 73
SECTION 2. This act shall take effect and be in force from 74
and after its passage. 75
