AN ACT TO CREATE THE SMALL MUNICIPALITY STREET AND 1
INFRASTRUCTURE IMPROVEMENT PILOT PROGRAM, WHICH SHALL BE 2

FUNDS IN THE PROGRAM ON A COMPETITIVE BASIS TO MUNICIPALITIES 7
MEETING ELIGIBILITY CRITERIA ESTABLISHED BY MDA; TO SPECIFY 8
ELIGIBILITY AND PRIORITIZATION CRITERIA FOR THE FUNDS; AND FOR 9
RELATED PURPOSES. 10
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 11
SECTION 1. (1) There is created the Small Municipality 12
Street and Infrastructure Improvement Pilot Program, which shall 13
be administered by the Mississippi Development Authority (MDA) to 14
assist eligible municipalities with populations under ten thousand 15
(10,000) with construction, engineering, and related costs 16
associated with water, sewer, street overlay and roadway 17
improvement projects. 18
(2) MDA shall award the funds in the program on a 19
competitive basis to municipalities meeting eligibility criteria 20
established by MDA. Eligibility and prioritization criteria for 21
the funds may include, but shall not be limited to: 22

(a) Population under ten thousand (10,000); 23
(b) Demonstrated infrastructure need; 24
(c) Project readiness, including completed or 25
substantially completed engineering and cost estimates; 26
(d) Availability of local matching funds; and 27
(e) Rural or underserved community status. 28
(3) Eligible uses of funds may include, but shall not be 29
limited to: 30
(a) Water and sewer projects; 31
(b) Street and roadway overlay projects; 32
(c) Engineering, design, and planning costs; and 33
(d) Construction-related expenses directly associated 34
with approved infrastructure projects. 35
(4) MDA may promulgate rules, guidelines, and application 36
procedures necessary to administer the program and may require 37
participating municipalities to submit documentation, 38
certifications, and post-project reports demonstrating the use of 39
funds and the impact of funded projects. 40
SECTION 2. This act shall take effect and be in force from 41
and after July 1, 2026. 42
