AN ACT TO AUTHORIZE A ONE-TIME FIVE-YEAR EXTENSION FOR 1
CERTAIN FIRE APPARATUS OPERATED BY MUNICIPALITIES AND FIRE 2
PROTECTION DISTRICTS BEYOND THE CURRENT TWENTY-YEAR SERVICE LIMIT 3
IF CERTAIN SAFETY AND OPERATION CERTIFICATION ARE MET; AND FOR 4
RELATED PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. Notwithstanding any provision of law or 7
regulation to the contrary, a fire apparatus operated by a 8
municipality, county, or fire protection district that has reached 9
the maximum service life of twenty (20) years may be granted a 10
one-time service life extension not to exceed five (5) additional 11
years, provided the apparatus meets all requirements established 12
under this act. 13
SECTION 2. To qualify for the service life extension, the 14
fire apparatus must: 15
(a) Successfully pass a comprehensive mechanical, 16
safety, and operational inspection conducted by a certified fire 17
apparatus inspector or other qualified authority approved by the 18
State Fire Marshal; 19

(b) Meet or exceed minimum safety standards established 21
by the State Fire Marshal, which may include braking systems, pump 22
performance, structural integrity, emergency lighting, and 23
essential operational components; 24
(c) Be certified as safe for continued service for each 25
year of the extension period; and 26
(d) Not have previously received a service life 27
extension under this act. 28
SECTION 3. The State Fire Marshal, in consultation with the 29
Mississippi Insurance Department and relevant fire service 30
organizations, shall promulgate rules and guidelines necessary to 31
implement this act, including inspection criteria, certification 32
procedures, documentation requirements, and annual review 33
standards. 34
SECTION 4. Nothing in this act shall be construed to require 35
a municipality or fire protection district to extend the service 36
life of any fire apparatus. The decision to seek an extension 37
shall remain at the discretion of the governing authority. 38
SECTION 5. This act shall take effect and be in force from 39
and after July 1, 2026. 40
