HOUSE BILL NO. 1541

AN ACT TO AMEND SECTION 97-3-5, MISSISSIPPI CODE OF 1972, TO 1
PROHIBIT THE MANUFACTURE OR MAIL ORDER IN THIS STATE OF MEDICINES 2
THAT CAUSE ANY ABORTION THAT IS PROHIBITED BY THE LAWS OF THIS 3
STATE; AND FOR RELATED PURPOSES. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 5
SECTION 1. Section 97-3-5, Mississippi Code of 1972, is 6
amended as follows: 7
97-3-5. A person who manufactures, markets, mails, 8
distributes, transports, delivers, sells, lends, gives away, or in 9
any manner exhibits, or offers to manufacture, market, mail, 10
distribute, transport, deliver, sell, lend, or give away, or has 11
in his or her possession with intent to manufacture, market, mail, 12
distribute, transport, deliver, sell, lend, or give away, or 13
advertises or offers for sale, loan or distribution any instrument 14
or article, or any drug or medicine, for causing * * * an abortion 15
that is prohibited in this state; or who writes or prints, or 16
causes to be written or printed, a card, circular, pamphlet, 17
advertisement, or notice of any kind, or gives information orally, 18
stating when, where, how, of whom, or by what means such 19

instrument, article or medicine can be purchased or obtained, or 20
who manufactures any such instrument, article or medicine, is 21
guilty of a * * * felony, and, * * * upon conviction, shall be 22
punished by a fine not less than * * * One Thousand Dollars 23
($1,000.00) nor more than * * * Ten Thousand Dollars ($10,000.00), 24
and by imprisonment in the * * * custody of the Department of 25
Corrections for not less than two (2) years nor more than five (5) 26
years, or both. 27
SECTION 2. This act shall take effect and be in force from 28
and after July 1, 2026. 29
