HOUSE BILL NO. 1558
AN ACT TO AMEND SECTION 19-5-171, MISSISSIPPI CODE OF 1972, 1
TO STIPULATE THAT THE COMMISSIONERS OF THE TISHOMINGO COUNTY WATER 2
DISTRICT SHALL BE COMPENSATED FOR THEIR SERVICES AT A RATE UP TO 3
$84.00 PER DAY UNDER CERTAIN CONDITIONS; AND FOR RELATED PURPOSES. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 5
SECTION 1. Section 19-5-171, Mississippi Code of 1972, is 6
amended as follows: 7
19-5-171. (1) Every resident citizen of the county in which 8
is located in any district created under Sections 19-5-151 through 9
19-5-207, of good reputation, being the owner of land or the 10
conductor of a business situated within the district and being 11
over twenty-five (25) years of age and of sound mind and judgment, 12
shall be eligible to hold the office of commissioner. 13
(2) Except as provided in Section 19-5-164(3), each person 14
appointed or elected as a commissioner, before entering upon the 15
discharge of the duties of the person's office, shall be required 16
to execute a bond payable to the State of Mississippi in the penal 17
sum of not less than Fifty Thousand Dollars ($50,000.00) 18
conditioned that the person will faithfully discharge the duties 19

of the office. Each bond shall be approved by the clerk of the 20
board of supervisors and filed with the clerk. 21
(3) Each commissioner shall take and subscribe to an oath of 22
office prescribed in Section 268, Mississippi Constitution of 23
1890, before the clerk of the board of supervisors that the person 24
will faithfully discharge the duties of the office of 25
commissioner, which oath shall also be filed with the clerk and 26
preserved with the official bond. 27
(4) Except as provided in subsection (5), the commissioners 28
so appointed or elected and qualified shall be compensated for 29
their services for each meeting of the board of commissioners 30
attended, either regular or special, at a rate to be fixed by the 31
board of supervisors, not to exceed the rate established in 32
Section 25-3-69 for officers of state boards, commissions and 33
agencies, and shall be reimbursed for all expenses necessarily 34
incurred in the discharge of their official duties in accordance 35
with Section 25-3-41. However, in no one (1) calendar year shall 36
any commissioner be compensated for more than twenty-four (24) 37
meetings. 38
(5) (a) The commissioners of the Hancock County Water and 39
Sewer District shall be compensated for their services at a rate 40
up to Eighty-four Dollars ($84.00) per day for each meeting of the 41
board of commissioners attended, either regular or special, and 42
shall be reimbursed for all expenses necessarily incurred in the 43

discharge of their official duties in accordance with Section 44
25-3-41. 45
(b) The commissioners of the Kiln Utility and Fire 46
District of Hancock County shall be compensated for their services 47
at a rate up to Eighty-four Dollars ($84.00) per day for each 48
meeting of the board of commissioners attended, either regular or 49
special, and shall be reimbursed for all expenses necessarily 50
incurred in the discharge of their official duties in accordance 51
with Section 25-3-41. 52
(c) The commissioners of the Pearlington Water and 53
Sewer District of Hancock County shall be compensated for their 54
services at a rate up to Eighty-four Dollars ($84.00) per day for 55
each meeting of the board of commissioners attended, either 56
regular or special, and shall be reimbursed for all expenses 57
necessarily incurred in the discharge of their official duties in 58
accordance with Section 25-3-41. 59
(d) The commissioners of the Diamondhead Water and 60
Sewer District of Hancock County shall be compensated for their 61
services at a rate up to Eighty-four Dollars ($84.00) per day for 62
each meeting of the board of commissioners attended, either 63
regular or special, and shall be reimbursed for all expenses 64
necessarily incurred in the discharge of their official duties in 65
accordance with Section 25-3-41. 66
(e) The commissioners of the Hancock County Solid Waste 67
Authority shall be compensated for their services at a rate up to 68

provisions relating to compensation and
reimbursement.
Eighty-four Dollars ($84.00) per day for each meeting of the board 69
of commissioners attended, either regular or special, and shall be 70
reimbursed for all expenses necessarily incurred in the discharge 71
of their official duties in accordance with Section 25-3-41. 72
(f) The commissioners of the Tishomingo County Water 73
District shall be compensated for their services at a rate of up 74
to Eighty-four Dollars ($84.00) per day for each meeting of the 75
board of commissioners attended, either regular or special, and 76
shall be reimbursed for all expenses necessarily incurred in the 77
discharge of their official duties in accordance with Section 78
25-3-41. 79
SECTION 2. This act shall take effect and be in force from 80
and after July 1, 2026. 81
