AN ACT TO AMEND SECTION 23-15-191, MISSISSIPPI CODE OF 1972, 1
TO REQUIRE MISSISSIPPI PRIMARIES TO BE HELD ON THE DATE DESIGNATED 2

CODE OF 1972, FOR PURPOSES OF POSSIBLE AMENDMENT; AND FOR RELATED 4
PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. Section 23-15-191, Mississippi Code of 1972, is 7
amended as follows: 8
23-15-191. (1) Except as otherwise provided in subsection 9
(2) of this section, the first primary shall be held on the first 10
Tuesday after the first Monday of August preceding any regular or 11
general election; and the second primary shall be held four (4) 12
weeks thereafter. The candidate that receives a majority of the 13
votes cast in the election shall be the party nominee. If no 14
candidate receives a majority vote at the election, then the two 15
(2) candidates who receive the highest number of votes shall have 16
their names placed on the ballot for the second primary election 17
to be held four (4) weeks later. The candidate who receives the 18
most votes in the second primary election shall be the party 19

nominee. However, if no candidate receives a majority vote at the 20
first primary, and there is a tie in the election of those 21
receiving the next highest vote, then those candidates receiving 22
the next highest vote and the candidate receiving the highest vote 23
shall have their names placed on the ballot for the second primary 24
election to be held four (4) weeks later, and whoever receives the 25
most votes cast in the second primary election shall be the party 26
nominee. 27
(2) In any year in which there is a date preceding a regular 28
or general election which is recognized across the country as 29
Super Tuesday, the first primary election shall be held on the day 30
recognized as Super Tuesday. If more than one (1) day is 31
recognized as Super Tuesday during any year, the first primary 32
election shall be held on the earliest day designated as Super 33
Tuesday. As soon as the date of Super Tuesday in a given year has 34
been identified, the Secretary of State shall certify that date as 35
the day of the primary election in Mississippi for that year. The 36
second primary shall be held four (4) weeks thereafter. The 37
candidate that receives a majority of the votes cast in the 38
election shall be the party nominee. If no candidate receives a 39
majority vote at the election, then the two (2) candidates who 40
receive the highest number of votes shall have their names placed 41
on the ballot for the second primary election to be held four (4) 42
weeks later. The candidate who receives the most votes in the 43
second primary election shall be the party nominee. However, if 44

no candidate receives a majority vote at the first primary, and 45
there is a tie in the election of those receiving the next highest 46
vote, then those candidates receiving the next highest vote and 47
the candidate receiving the highest vote shall have their names 48
placed on the ballot for the second primary election to be held 49
four (4) weeks later, and whoever receives the most votes cast in 50
the second primary election shall be the party nominee. 51
SECTION 2. Section 23-15-303, Mississippi Code of 1972, is 52
brought forward as follows: 53
23-15-303. When two (2) or more political parties or 54
political organizations are holding primary elections, each shall 55
be conducted entirely independent of the other but at the same 56
time. 57
SECTION 3. This act shall take effect and be in force from 58
and after July 1, 2026. 59
