HOUSE BILL NO. 1712
AN ACT TO AMEND SECTION 41-29-117, MISSISSIPPI CODE OF 1972, 1
TO ADD KRATOM TO SCHEDULE III OF THE UNIFORM CONTROLLED SUBSTANCES 2
ACT; AND FOR RELATED PURPOSES. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 4
SECTION 1. Section 41-29-117, Mississippi Code of 1972, is 5
amended as follows: 6
41-29-117. (A) The controlled substances listed in this 7
section are included in Schedule III. 8
SCHEDULE III 9
(a) Stimulants. Any material, compound, mixture, or 10
preparation which contains any quantity of the following 11
substances or their salts, isomers, or salts of isomers, of the 12
following substances: 13
(1) Benzphetamine; 14
(2) Chlorphentermine; 15
(3) Clortermine; 16
(4) Phendimetrazine. 17

(b) Depressants. Unless listed in another schedule, 18
any material, compound, mixture, or preparation which contains any 19
quantity of the following substances: 20
(1) Any substance which contains any quantity of a 21
derivative of barbituric acid, or any salt of a derivative of 22
barbituric acid, except those substances which are specifically 23
listed in other schedules; 24
(2) Unless specifically excepted or unless listed 25
in another schedule, any compound, mixture or preparation 26
containing any of the following substances or any salt of the 27
substances specifically included in this subsection (2) and one or 28
more other active medicinal ingredients which are not listed in 29
any other schedule: 30
(i) Amobarbital; 31
(ii) Secobarbital; 32
(iii) Pentobarbital; 33
(3) Any suppository dosage form containing any of 34
the following substances or any salt of any of the substances 35
specifically included in this subsection (3) approved by the Food 36
and Drug Administration for marketing only as a suppository: 37
(i) Amobarbital; 38
(ii) Secobarbital; 39
(iii) Pentobarbital; 40
(4) Chlorhexadol; 41
(5) Embutramide; 42

(6) Any drug product containing 43
gamma-hydroxybutyric acid, including its salts, isomers and salts 44
of isomers, for which an application is approved under Section 505 45
of the Federal Food, Drug and Cosmetic Act; 46
(7) Ketamine; its salts, isomers, and salts of 47
isomers; other names include 48
(+)-2-(2-chlorophenyl)-2-(methylamino)cyclohexanone; 49
(8) Lysergic acid; 50
(9) Lysergic acid amide; 51
(10) Methyprylon; 52
(11) Perampanel; its salts, isomers, and salts of 53
isomers; 54
(12) Sulfondiethylmethane; 55
(13) Sulfonethylmethane; 56
(14) Sulfonmethane; 57
(15) Tiletamine and zolazepam or any salt thereof; 58
other names for the tiletamine and zolazepam combination product 59
include: telazol; other names for tiletamine include: 60
2-(ethylamino)-2-(2-thienyl)-cyclohexanone; other names for 61
zolazepam include: 4-(2-fluorophenyl)-6,8-dihydro 1,3, 62
8-trimethylpyrazolo-[3,4-e](1,4)-diazepin-7(1H)-one, flupyrazapon. 63
(c) Nalorphine. 64
(d) Any material, compound, mixture or preparation 65
which contains any quantity of ephedrine or pseudoephedrine, 66
except for any product that contains any quantity of 67

pseudoephedrine or ephedrine that is sold subject to the quantity 68
restrictions authorized in Section 73-21-124. 69
(e) Narcotic drugs. Any material, compound, mixture, 70
or preparation containing limited quantities of any of the 71
following narcotic drugs, or any salts thereof: 72
(1) Not more than one and eight-tenths (1.8) grams 73
of codeine, or any of its salts, per one hundred (100) milliliters 74
or not more than ninety (90) milligrams per dosage unit, with an 75
equal or greater quantity of an isoquinoline alkaloid of opium; 76
(2) Not more than one and eight-tenths (1.8) grams 77
of codeine, or any of its salts, per one hundred (100) milliliters 78
or not more than ninety (90) milligrams per dosage unit, with one 79
or more active, nonnarcotic ingredients in recognized therapeutic 80
amounts; 81
(3) Not more than one and eight-tenths (1.8) grams 82
of dihydrocodeine, or any of its salts, per one hundred (100) 83
milliliters or not more than ninety (90) milligrams per dosage 84
unit, with one or more active, nonnarcotic ingredients in 85
recognized therapeutic amounts; 86
(4) Not more than three hundred (300) milligrams 87
of ethylmorphine, or any of its salts, per one hundred (100) 88
milliliters or not more than fifteen (15) milligrams per dosage 89
unit, with one or more active, nonnarcotic ingredients in 90
recognized therapeutic amounts; 91

(5) Not more than five hundred (500) milligrams of 92
opium per one hundred (100) milliliters or per one hundred (100) 93
grams, or not more than twenty-five (25) milligrams per dosage 94
unit, with one or more active, nonnarcotic ingredients in 95
recognized therapeutic amounts; 96
(6) Not more than fifty (50) milligrams of 97
morphine, or any of its salts, per one hundred (100) milliliters 98
or per one hundred (100) grams with one or more active, 99
nonnarcotic ingredients in recognized therapeutic amounts. 100
(f) Anabolic steroids. Unless specifically exempted or 101
listed in another schedule, any material, compound, mixture or 102
preparation containing any quantity of any of the following 103
anabolic steroids (any drug or hormonal substance chemically and 104
pharmacologically related to testosterone other than estrogens, 105
progestins, corticosteroids and dehydroepiandrosterone): 106
(1) 3beta,17-dihydroxy-5a-androstane; 107
(2) 3alpha,17beta-dihydroxy-5a-androstane; 108
(3) 5alpha-androstan-3,17-dione; 109
(4) 1-androstenediol 110
(3beta,17beta-dihydroxy-5alpha-androst-1-ene); 111

species and that has been approved by the Secretary of Health and 239
Human Services for such administration. If any person prescribes, 240
dispenses, or distributes such steroid for human use, the person 241
shall be considered to have prescribed, dispensed or distributed 242
an anabolic steroid within the meaning of this paragraph. 243
(g) Any material, compound, mixture or preparation 244
which contains any quantity of buprenorphine or its salts. 245
(h) Dronabinol (synthetic) in sesame oil and 246
encapsulated in a soft gelatin capsule in a United States Food and 247
Drug Administration approved drug product. 248
(i) Any material, compound, mixture, or preparation 249
which contains any quantity of Tianeptine 250
(7-((3-chloro-6-methyl-5,5-dioxido-6,11-dihydrodibenzo[c,f][1,2]th251
iazepin-11-yl)amino)heptanoic acid) or its salts, isomers, salts 252
of isomers, sulfate, free acid or derivative thereof. 253
(j) Any material, compound, mixture or preparation that 254
contains any quantity of kratom (mitragynine and 255
7-hydroxymytragynine) or its salts, isomers, salts of isomers, 256
sulfate, free acid or derivative thereof. 257
(B) Any material, compound, mixture or preparation which 258
contains any quantity of a Schedule III controlled substance other 259
than butalbital, and is listed as an exempt substance in 21 CFR, 260
Section 1308.22, 1308.24, 1308.26, 1308.32 or 1308.34, shall be 261
exempted from the provisions of the Uniform Controlled Substances 262
Law. 263

SECTION 2. This act shall take effect and be in force from 264
