AN ACT TO AUTHORIZE THE MISSISSIPPI DEPARTMENT OF FINANCE AND 1
ADMINISTRATION TO SELL CERTAIN REAL PROPERTY AND IMPROVEMENTS 2
LOCATED IN THE CITY OF BILOXI, HARRISON COUNTY, MISSISSIPPI; TO 3
PRESCRIBE THE MANNER OF SALE; TO REQUIRE APPRAISAL OF THE 4
PROPERTY; TO PROVIDE FOR THE DISPOSITION OF THE PROCEEDS; AND FOR 5
RELATED PURPOSES. 6
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 7
SECTION 1. The Mississippi Department of Finance and 8
Administration is authorized, in its discretion and acting on 9
behalf of the State of Mississippi, to sell and convey all right, 10
title and interest of the State of Mississippi in and to the real 11
property and improvements located in the City of Biloxi, Harrison 12
County, Mississippi, commonly known as 1141 Bayview Avenue, 13
Biloxi, Mississippi, together with any improvements located 14
thereon and any property related thereto. The Department of 15
Finance and Administration shall obtain a legal description of the 16
property prior to conveyance, and such legal description shall be 17
included in the deed or other instrument of conveyance. 18
SECTION 2. The sale authorized under Section 1 of this act 19
may be made at public or private sale, for cash or upon such other 20

terms and conditions as the Department of Finance and 21
Administration may deem appropriate and in the best interest of 22
the State of Mississippi. The department is authorized to 23
advertise the sale in such manner as it determines appropriate and 24
may determine the manner and timing of the sale. The property 25
shall be sold for not less than the fair market value as 26
determined by two (2) professional, certified general appraisers 27
selected by the Department of Finance and Administration as 28
provided in Section 29-1-1. 29
SECTION 3. The Department of Finance and Administration is 30
authorized to execute and deliver, in the name of and on behalf of 31
the State of Mississippi, any deeds, bills of sale, or other 32
instruments necessary to convey the property. 33
SECTION 4. The proceeds derived from the sale of the real 34
property and improvements authorized under this act, after 35
deduction of reasonable costs and expenses incurred in connection 36
with the sale, shall be deposited into the State General Fund. 37
SECTION 5. This act shall take effect and be in force from 38
and after its passage. 39
