AN ACT TO AMEND SECTION 45-45-7, MISSISSIPPI CODE OF 1972, TO 1
CLARIFY THE CONVEYANCE EQUIPMENT WHICH IS NOT APPLICABLE TO THE 2
PROVISIONS OF THE MISSISSIPPI CONVEYANCE SAFETY ACT AND TO 3
PRESCRIBE CERTAIN INSPECTIONS WHICH ARE APPLICABLE TO PRIVATE 4
RESIDENCE ELEVATORS; AND FOR RELATED PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. Section 45-45-7, Mississippi Code of 1972, is 7
amended as follows: 8
45-45-7. (1) Equipment not covered by this chapter 9
includes, but is not limited to, the following: 10
(a) Material hoists within the scope of ANSI A10.5; 11
(b) Man lifts within the scope of ASME A90.1; 12
(c) Mobile scaffolds, towers and platforms within the 13
scope of ANSI A92; 14
(d) Powered platforms and equipment for exterior and 15
interior maintenance within the scope of ANSI A120.1; 16
(e) Conveyors and related equipment within the scope of 17
ASME B20.1; 18

(f) Cranes, derricks, hoists, hooks, jacks and slings 19
within the scope of ASME B30; 20
(g) Industrial trucks within the scope of ASME B56; 21
(h) Portable equipment, except for portable escalators 22
that are covered by ASME A17.1/CSA B44 and ASME A17.7/CSA B44.7; 23
(i) Tiering or piling machines used to move materials 24
to and from storage located and operating entirely within one (1) 25
story; 26
(j) Equipment for feeding or positioning materials at 27
machine tools, printing presses, or similar equipment; 28
(k) Kip or furnace hoists; 29
(l) Wharf ramps; 30
(m) Railroad car lifts or dumpers; and 31
(n) Line jacks, false cars, shafters, moving platforms 32
and similar equipment used for installing an elevator by an 33
elevator contractor licensed in this state. 34
(2) The provisions of this chapter shall not apply to any 35
conveyance that is located in a private residence, except that 36
upon completion of installation, modification, or alteration of a 37
private resident elevator, licensed elevator inspector shall 38
conduct an acceptance inspection per the most recent adopted 39
version of ASME A17.1/CSA B44, before the elevator is placed in 40
service. Upon the completion of the final acceptance inspection, 41
the owner shall register the private residence elevator with the 42
Mississippi Conveyance Safety Act Division of the Mississippi 43

Insurance Department on a form furnished by the division, and the 44
division shall maintain a database of registered elevators. 45
SECTION 2. This act shall take effect and be in force from 46
and after July 1, 2026. 47
