AN ACT TO PROVIDE FOR THE SCHEDULING OF SCHOOL 1
EXTRACURRICULAR ACTIVITIES TO PROMOTE STUDENT WELL-BEING AND 2
SAFETY; TO REQUIRE COMPLIANCE WITH SPECIFIC GUIDELINES; TO MANDATE 3
REPORTING OF NONCOMPLIANCE TO THE STATE DEPARTMENT OF EDUCATION 4
AND THE LEGISLATURE; AND FOR RELATED PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. The Legislature finds that: 7
(a) Extracurricular activities play a vital role in the 8
holistic development of students; 9
(b) Balancing academics, extracurricular activities, 10
personal life, and rest is essential for student success and 11
well-being; and 12
(c) Bus drivers for extracurricular activities are 13
often school personnel whose extended workdays may pose safety 14
risks due to fatigue. The purpose of this act is to establish 15
guidelines for scheduling school extracurricular activities to 16
prioritize student well-being, ensure academic attendance, and 17
enhance transportation safety. 18

SECTION 2. (1) (a) Each school district shall adopt a 19
policy requiring that routine district and nondistrict 20
extracurricular activities shall be scheduled in a manner which: 21
(i) Ensures students attend all regular classes of 22
academic instruction before traveling for the activity. 23
(ii) Requires students to be returned to their 24
school by 10:30 p.m. on school nights. For the purposes of this 25
section, "school night" is defined as the night preceding any day 26
of the week in which academic instruction occurs during the course 27
of a regular scholastic year, and shall include any required 28
make-up days imposed by the school district for all students in 29
enrollment. 30
(b) Each school district shall require all parties 31
responsible for scheduling of extracurricular activities, 32
including third-party schedulers with whom it has entered into 33
agreement for the delegation of its scheduling responsibilities, 34
to adhere to the requirements of paragraph (a) of this subsection. 35
(2) The requirement to adhere to the structured scheduling 36
of extracurricular activities under subsection (1) of this section 37
shall not apply to: 38
(a) Playoff and/or championship extracurricular 39
activities and statewide competitions in which the school is a 40
competing party; and 41
(b) Extracurricular activities that involve prearranged 42
overnight stays. 43

(3) Any occurrence of noncompliance with the guidelines in 44
subsection (1), except as otherwise exempted under subsection (2), 45
shall be documented with specific details of the noncompliance and 46
the reason for the noncompliance. 47
(4) (a) Each school district shall report all documented 48
occurrences of noncompliance to the State Department of Education 49
on a quarterly basis. 50
(b) The department shall compile and provide a summary 51
of these reports to the Education Committees of the Mississippi 52
House of Representatives and Senate on a quarterly basis. 53
(5) The department shall develop rules and regulations to 54
implement and enforce the provisions of this act. 55
SECTION 3. This act shall take effect and be in force from 56
and after July 1, 2026. 57
