AN ACT TO PROVIDE THAT CONTRACTS THAT ESTABLISH OR MODIFY THE TERMS OF A PARTNERSHIP, EMPLOYMENT OR ANY OTHER FORM OF PROFESSIONAL RELATIONSHIP WITH A HEALTH CARE PROVIDER WHO IS LICENSED IN MISSISSIPPI, WHICH INCLUDE ANY RESTRICTION OF THE RIGHT OF THE HEALTH CARE PROVIDER TO PRACTICE HIS OR HER PROFESSION OR OCCUPATION IN ANY GEOGRAPHIC AREA FOR ANY PERIOD OF TIME AFTER THE TERMINATION OF SUCH PARTNERSHIP, EMPLOYMENT OR PROFESSIONAL RELATIONSHIP, SHALL BE VOID AND UNENFORCEABLE WITH RESPECT TO THAT RESTRICTION; AND FOR RELATED PURPOSES.

AN ACT TO PROVIDE THAT CONTRACTS THAT ESTABLISH OR MODIFY THE 1
TERMS OF A PARTNERSHIP, EMPLOYMENT OR ANY OTHER FORM OF 2
PROFESSIONAL RELATIONSHIP WITH A HEALTH CARE PROVIDER WHO IS 3
LICENSED IN MISSISSIPPI, WHICH INCLUDE ANY RESTRICTION OF THE 4
RIGHT OF THE HEALTH CARE PROVIDER TO PRACTICE HIS OR HER 5
PROFESSION OR OCCUPATION IN ANY GEOGRAPHIC AREA FOR ANY PERIOD OF 6
TIME AFTER THE TERMINATION OF SUCH PARTNERSHIP, EMPLOYMENT OR 7
PROFESSIONAL RELATIONSHIP, SHALL BE VOID AND UNENFORCEABLE WITH 8
RESPECT TO THAT RESTRICTION; AND FOR RELATED PURPOSES. 9
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 10
SECTION 1. (1) As used in this section, the following terms 11
shall be defined as provided in this subsection: 12
(a) "Health care" means any care, treatment, service or 13
procedure to maintain, diagnose or otherwise affect a person's 14
physical or mental condition. 15
(b) "Health care provider" means a person licensed, 16
certified or otherwise authorized or permitted by Mississippi law 17
to provide health care in the ordinary course of business or 18
practice of a profession. 19
(2) Any contract or agreement that creates, establishes or 20
modifies the terms of a partnership, employment or any other form 21

of professional relationship with a health care provider who is 22
licensed in Mississippi, which includes any restriction of the 23
right of the health care provider to practice his or her 24
profession or occupation in any geographic area for any period of 25
time after the termination of such partnership, employment or 26
professional relationship, shall be void and unenforceable with 27
respect to that restriction. Nothing in this subsection shall 28
render void or unenforceable the remaining provisions of any such 29
contract or agreement. 30
(3) This section shall apply to all contracts or agreements 31
described in subsection (2) of this section that are entered into 32
or renewed on or after July 1, 2026. 33
SECTION 2. This act shall take effect and be in force from 34
and after July 1, 2026. 35
