HOUSE BILL NO. 52

AN ACT TO AUTHORIZE PHARMACISTS TO DISPENSE IVERMECTIN 1
WITHOUT REQUIRING A PRESCRIPTION FROM A LICENSED HEALTH CARE 2
PRACTITIONER; TO PROVIDE IMMUNITY FOR PHARMACISTS DISPENSING 3
IVERMECTIN IN A REASONABLY PRUDENT MANNER IN ACCORDANCE WITH THIS 4
ACT; AND FOR RELATED PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. (1) A pharmacist may dispense ivermectin to a 7
person, without requiring a prescription from a licensed health 8
care practitioner, in accordance with any written standardized 9
procedures or protocols issued by the State Board of Pharmacy, 10
including, if required, providing the person with instructions on 11
the proper use of ivermectin. 12
(2) A pharmacist acting in a reasonably prudent manner is 13
not criminally or civilly liable or subject to professional 14
disciplinary action for dispensing ivermectin in accordance with 15
this section. 16
(3) The State Board of Pharmacy may adopt the rules 17
necessary to implement this section. 18
