AN ACT TO AMEND SECTION 41-29-111, MISSISSIPPI CODE OF 1972, 1
TO PROVIDE FOR AUTOMATIC STATE SCHEDULING OF PSILOCYBIN AFTER 2
FEDERAL SCHEDULING; TO BRING FORWARD SECTIONS 41-29-113 THROUGH 3
41-29-121, MISSISSIPPI CODE OF 1972, WHICH RELATE TO THE UNIFORM 4
CONTROLLED SUBSTANCES LAW, FOR PURPOSES OF POSSIBLE AMENDMENT; AND 5
FOR RELATED PURPOSES. 6
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 7
SECTION 1. Section 41-29-111, Mississippi Code of 1972, is 8
amended as follows: 9
41-29-111. (1) The Commissioner of Public Safety shall 10
administer this article and shall work in conjunction and 11
cooperation with the State Board of Pharmacy, county and municipal 12
law enforcement agencies, the district and county attorneys, the 13
Office of the Attorney General and the Mississippi Bureau of 14
Narcotics. The State Board of Health shall work with the bureau 15
in an advisory capacity and shall be responsible for recommending 16
to the Legislature the appropriate schedule for all substances to 17
be scheduled or rescheduled in Sections 41-29-113 through 18
41-29-121. In making a recommendation regarding a substance, the 19
State Board of Health shall consider the following: 20

(a) (i) The actual or relative potential for abuse; 21
(ii) The scientific evidence of its 22
pharmacological effect, if known; 23
(iii) The state of current scientific knowledge 24
regarding the substance; 25
(iv) The history and current pattern of abuse; 26
(v) The scope, duration and significance of abuse; 27
(vi) The risk to the public health; 28
(vii) The potential of the substance to produce 29
psychic or physiological dependence liability; and 30
(viii) Whether the substance is an immediate 31
precursor of a substance already controlled under this article. 32
(b) After considering the factors enumerated in 33
paragraph (a), the State Board of Health shall make findings with 34
respect thereto and issue a recommendation to control the 35
substance if it finds the substance has a potential for abuse. 36
(c) If the State Board of Health designates a substance 37
as an immediate precursor, substances that are precursors of the 38
controlled precursor shall not be recommended for control solely 39
because they are precursors of the controlled precursor. 40
(d) If any substance is designated, rescheduled, or 41
deleted as a controlled substance under federal law and notice 42
thereof is given to the State Board of Health, it shall recommend 43
the control of the substance under this article at the next 44
session of the Legislature. 45

(e) (i) Authority to control under this article does 46
not extend to distilled spirits, wine, malt beverages, or tobacco 47
as those terms are defined or used in the Local Option Alcoholic 48
Beverage Control Law, being Sections 67-1-1 through 67-1-91, and 49
the Tobacco Tax Law of 1934, being Sections 27-69-1 through 50
27-69-77. It is the intent of the Legislature of the State of 51
Mississippi that the bureau shall concentrate its efforts and 52
resources on the enforcement of the Uniform Controlled Substances 53
Law with respect to illicit narcotic and drug traffic in the 54
state. 55
(ii) The controlled substances listed in the 56
schedules in Sections 41-29-113 through 41-29-121 are included by 57
whatever official, common, usual, chemical or trade name 58
designated. 59
(f) The State Board of Health shall recommend the 60
exclusion of any nonnarcotic substance from a schedule if such 61
substance may, under the Federal Food, Drug and Cosmetic Act and 62
the laws of this state, be lawfully sold over the counter without 63
a prescription. 64
(2) Any drug that is scheduled on the federal schedule for 65
the purpose of preventing or treating COVID-19 is automatically 66
scheduled on the corresponding state schedule in Sections 67
41-29-113 through 41-29-121. This automatic scheduling is 68
effective from the date that the COVID-19-related drug is 69
designated on the federal schedule until the effective date of 70

legislation amending the corresponding state schedule in the next 71
regular session of the Legislature. 72
(3) Not withstanding any law to the contrary, any 73
pharmaceutical composition of crystalline polymorph psilocybin 74
that is approved by the United States Food and Drug Administration 75
and is then scheduled by the United States Drug Enforcement 76
Administration is automatically scheduled on the corresponding 77
state schedule in Sections 41-29-113 through 41-29-121. This 78
automatic scheduling is effective from the date that the drug is 79
designated on the federal schedule until the effective date of 80
legislation amending the corresponding state schedule in the next 81
regular legislative session of the Legislature. 82

(f) Any material, compound, mixture or preparation which 1253
contains any quantity of a Schedule V controlled substance and is 1254
listed as an exempt substance in 21 CFR, Section 1308.22, 1308.24, 1255
1308.26, 1308.32 or 1308.34, shall be exempted from the provisions 1256
of the Uniform Controlled Substances Law. 1257
SECTION 7. This act shall take effect and be in force from 1258
and after its passage. 1259
