AN ACT TO AMEND SECTION 17-25-19, MISSISSIPPI CODE OF 1972, 1
TO PROHIBIT THE BOARD OF SUPERVISORS OF ANY COUNTY OR THE 2
GOVERNING AUTHORITY OF ANY MUNICIPALITY FROM ENACTING OR ENFORCING 3
ORDINANCES AUTHORIZING THE USE OF AUTOMATED RECORDING EQUIPMENT OR 4
SYSTEMS TO ENFORCE COMPLIANCE WITH AUTOMOBILE INSURANCE 5
REQUIREMENTS; AND FOR RELATED PURPOSES. 6
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 7
SECTION 1. Section 17-25-19, Mississippi Code of 1972, is 8
amended as follows: 9
17-25-19. (1) (a) Neither the board of supervisors of any 10
county nor the governing authority of any municipality shall 11
adopt, enact or enforce any ordinance authorizing the use of 12
automated recording equipment or system to enforce compliance with 13
automobile insurance requirements, traffic signals, traffic speeds 14
or other traffic laws, rules or regulations on any public street, 15
road or highway within this state or to impose or collect any 16
civil or criminal fine, fee or penalty for any such violation. 17
(b) Any county or municipality using automated 18
recording equipment or system shall remove the equipment or system 19
before October 1, 2009. 20

(c) Any county or municipality using automated 21
recording equipment or system to enforce compliance with 22
automobile insurance requirements shall remove the equipment or 23
system before October 1, 2026. 24
(2) For the purposes of this section, the term "automated 25
recording equipment or system" means a camera or optical device 26
installed to work in conjunction with a traffic control signal or 27
radar speed detection equipment, or both, and designed to record 28
images that depict the license plate attached to the rear of a 29
motor vehicle that is not operated in compliance with instructions 30
of the traffic control signal or the posted speed limit. 31
SECTION 2. This act shall take effect and be in force from 32
and after July 1, 2026. 33
