OF POSSIBLE AMENDMENT; AND FOR RELATED PURPOSES. 12
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 13
SECTION 1. (1) A candidate, political committee, political 14
party or conduit, as defined in subsection (5), may not accept any 15
contribution made with a credit card via the Internet unless: 16
(a) At the time of making the contribution, the person 17
making the contribution provides the credit card verification 18
value or code to the candidate, political committee, political 19
party or conduit; and 20
(b) Except as provided in subsection (2) of this 21
section, the billing address associated with the credit card is 22
located in the United States. 23

(2) If a contribution under subsection (1) of this section 24
is made by a United States citizen living outside of the United 25
States and the billing address associated with the credit card is 26
not located in the United States, the person making the 27
contribution shall provide to the candidate, political committee, 28
political party or conduit, at the time of making the 29
contribution, the mailing address of the location in the United 30
States that the person, if registered to vote in the United 31
States, uses for voter registration purposes. 32
(3) Each candidate, political committee, political party or 33
conduit shall maintain a record of the names and addresses of each 34
person making a contribution under this section for purposes of 35
making any disclosure report required by Sections 23-15-801 36
through 23-15-821. 37
(4) A financial institution that processes credit card 38
contributions via the Internet to a candidate, political 39
committee, political party or conduit without requiring the credit 40
card verification value or code and a billing address located in 41
the United States may be subject to a forfeiture in an amount 42
equal to the cumulative amount of such contributions. 43
(5) As used in this section, "conduit" means a person who 44
receives a contribution of money from a contributor on behalf of 45
a candidate, political committee or political party, deposits the 46
contribution in an account held by that person, and releases the 47

contribution to a candidate, political committee or political 48
party at the direction of the contributor. 49
SECTION 2. Section 23-15-807, Mississippi Code of 1972, is 50
brought forward as follows: 51
23-15-807. (a) Each candidate or political committee shall 52
file reports of contributions and disbursements in accordance with 53
the provisions of this section. All candidates or political 54
committees required to report such contributions and disbursements 55
may terminate the obligation to report only upon submitting a 56
final report that contributions will no longer be received or 57
disbursements made and that the candidate or committee has no 58
outstanding debts or obligations. The candidate, treasurer or 59
chief executive officer shall sign the report. 60
(b) Candidates seeking election, or nomination for election, 61
and political committees making expenditures to influence or 62
attempt to influence voters for or against the nomination for 63
election of one or more candidates or balloted measures at such 64
election, shall file the following reports: 65
(i) In any calendar year during which there is a 66
regularly scheduled election, a pre-election report shall be filed 67
no later than the seventh day before any election in which the 68
candidate or political committee has accepted contributions or 69
made expenditures and shall be completed as of the tenth day 70
before the election; 71

(ii) In 1987 and every fourth year thereafter, periodic 72
reports shall be filed no later than the tenth day after April 30, 73
May 31, June 30, September 30 and December 31, and shall be 74
completed as of the last day of each period; 75
(iii) In any calendar years except 1987 and except 76
every fourth year thereafter, a report covering the calendar year 77
shall be filed no later than January 31 of the following calendar 78
year; and 79
(iv) Except as otherwise provided in the requirements 80
of paragraph (i) of this subsection (b), unopposed candidates are 81
not required to file pre-election reports but must file all other 82
reports required by paragraphs (ii) and (iii) of this subsection 83
(b). 84
(c) All candidates for judicial office as defined in Section 85
23-15-975, or their political committees, shall file periodic 86
reports in the year in which they are to be elected no later than 87
the tenth day after April 30, May 31, June 30, September 30 and 88
December 31. Candidates for judicial office shall not be required 89
to file an annual report during an election year, but shall file 90
an annual report in all other years. 91
(d) Each report under this article shall disclose: 92
(i) For the reporting period and the calendar year, the 93
total amount of all contributions and the total amount of all 94
expenditures of the candidate or reporting committee, including 95
those required to be identified pursuant to paragraph (ii) of this 96

subsection (d) as well as the total of all other contributions and 97
expenditures during the calendar year. The reports shall be 98
cumulative during the calendar year to which they relate; 99
(ii) The identification of: 100
1. Each person or political committee who makes a 101
contribution to the reporting candidate or political committee 102
during the reporting period, whose contribution or contributions 103
within the calendar year have an aggregate amount or value in 104
excess of Two Hundred Dollars ($200.00) together with the date and 105
amount of any such contribution; 106
2. Each person or organization, candidate or 107
political committee who receives an expenditure, payment or other 108
transfer from the reporting candidate, political committee or its 109
agent, employee, designee, contractor, consultant or other person 110
or persons acting in its behalf during the reporting period when 111
the expenditure, payment or other transfer to the person, 112
organization, candidate or political committee within the calendar 113
year have an aggregate value or amount in excess of Two Hundred 114
Dollars ($200.00) together with the date and amount of the 115
expenditure; 116
(iii) The total amount of cash on hand of each 117
reporting candidate and reporting political committee; 118
(iv) In addition to the contents of reports specified 119
in paragraphs (i), (ii) and (iii) of this subsection (d), each 120
political party shall disclose: 121

1. Each person or political committee who makes a 122
contribution to a political party during the reporting period and 123
whose contribution or contributions to a political party within 124
the calendar year have an aggregate amount or value in excess of 125
Two Hundred Dollars ($200.00), together with the date and amount 126
of the contribution; 127
2. Each person or organization who receives an 128
expenditure or expenditures by a political party during the 129
reporting period when the expenditure or expenditures to the 130
person or organization within the calendar year have an aggregate 131
value or amount in excess of Two Hundred Dollars ($200.00), 132
together with the date and amount of the expenditure; 133
(v) Disclosure required under this section of an 134
expenditure to a credit card issuer, financial institution or 135
business allowing payments and money transfers to be made over the 136
Internet must include, by way of detail or separate entry, the 137
amount of funds passing to each person, business entity or 138
organization receiving funds from the expenditure. 139
(e) The appropriate office specified in Section 23-15-805 140
must be in actual receipt of the reports specified in this article 141
by 5:00 p.m. on the dates specified in subsection (b) of this 142
section. If the date specified in subsection (b) of this section 143
shall fall on a weekend or legal holiday then the report shall be 144
due in the appropriate office at 5:00 p.m. on the first working 145
day before the date specified in subsection (b) of this section. 146

The reporting candidate or reporting political committee shall 147
ensure that the reports are delivered to the appropriate office by 148
the filing deadline. The Secretary of State may approve specific 149
means of electronic transmission of completed campaign finance 150
disclosure reports, which may include, but not be limited to, 151
transmission by electronic facsimile (FAX) devices. 152
(f) (i) If any contribution of more than Two Hundred 153
Dollars ($200.00) is received by a candidate or candidate's 154
political committee after the tenth day, but more than forty-eight 155
(48) hours before 12:01 a.m. of the day of the election, the 156
candidate or political committee shall notify the appropriate 157
office designated in Section 23-15-805, within forty-eight (48) 158
hours of receipt of the contribution. The notification shall 159
include: 160
1. The name of the receiving candidate; 161
2. The name of the receiving candidate's political 162
committee, if any; 163
3. The office sought by the candidate; 164
4. The identification of the contributor; 165
5. The date of receipt; 166
6. The amount of the contribution; 167
7. If the contribution is in-kind, a description 168
of the in-kind contribution; and 169
8. The signature of the candidate or the treasurer 170
or chair of the candidate's political organization. 171

(ii) The notification shall be in writing, and may be 172
transmitted by overnight mail, courier service, or other reliable 173
means, including electronic facsimile (FAX), but the candidate or 174
candidate's committee shall ensure that the notification shall in 175
fact be received in the appropriate office designated in Section 176
23-15-805 within forty-eight (48) hours of the contribution. 177
SECTION 3. Section 23-15-819, Mississippi Code of 1972, is 178
brought forward as follows: 179
23-15-819. (1) It shall be unlawful for a foreign national, 180
directly or through any other person, to make any contribution or 181
any expenditure of money or other thing of value, or to promise 182
expressly or impliedly to make any such contribution or 183
expenditure, in connection with an election to any political 184
office or in connection with any primary election, convention or 185
caucus held to select candidates for any political office. 186
(2) No person shall solicit, accept or receive any such 187
contribution from a foreign national. 188
(3) The term "foreign national" means: 189
(a) A foreign national as defined in 22 USCS 611(b), 190
except that the terms "foreign national" does not include any 191
individual who is a citizen of the United States; or 192
(b) An individual who is not a citizen of the United 193
States and who is not lawfully admitted for permanent residence. 194
SECTION 4. Section 1 of this act shall be codified in 195
Article 23, Chapter 23 of the Mississippi Code of 1972. 196

SECTION 5. This act shall take effect and be in force from 197
and after July 1, 2026. 198
