AN ACT TO CREATE THE HOLLY SPRINGS UTILITY DEPARTMENT BOARD; 1
TO PROVIDE THE MEMBERSHIP AND COMPOSITION OF THE BOARD; TO PROVIDE 2
THE DUTIES OF THE BOARD; AND FOR RELATED PURPOSES. 3
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 4
SECTION 1. There is created the Holly Springs Utility 5
Department Board and such board shall consist of the following 6
nine (9) members: 7
(a) Five (5) members appointed by the governing 8
authority of the City of Holly Springs, Mississippi; 9
(b) Two (2) members appointed by the Marshall County 10
Board of Supervisors; and 11
(c) Two (2) members appointed by the Benton County 12
Board of Supervisors. 13
The term of office of the board shall be for four (4) years. 14
When making initial appointments under this section, the 15
appointing authorities shall stagger the terms of such appointees 16
provided that no initial appointment is made for a period of less 17

than one (1) year nor more than four (4) years; thereafter, all 18
appointments shall be for terms of four (4) years. 19
The board members shall have the power, authority and duty to 20
manage and control the system or systems of the Holly Springs 21
Utility Department and the supply of the facilities and services 22
thereof, both within and without the limits of the municipality. 23
Such board members shall be qualified electors of their respective 24
appointing authorities and shall not hold any other county or 25
municipal office for honor or profit. Such board members shall 26
receive such compensation as may be specified and provided by 27
their respective appointing authorities; however, the compensation 28
for every board member shall be equal regardless of the appointing 29
authority. 30
The appointed authorities are hereby authorized and empowered 31
to require the board members to furnish bonds for the faithful 32
performance of their duties, in the amount as may be deemed 33
proper, and to pay the premiums thereon from the appointing 34
authorities from their respective treasury or the available funds 35
of the system or systems. 36
A board member may be removed for cause by the appointing 37
authority with ratification by a chancery judge. 38
SECTION 2. This act shall take effect and be in force from 39
and after July 1, 2026. 40
