AN ACT TO AMEND SECTION 41-125-19, MISSISSIPPI CODE OF 1972, 1
TO PROVIDE THAT PHYSICAL THERAPISTS DO NOT NEED TO HAVE PRIOR WORK 2
EXPERIENCE IN ORDER TO WORK AT A PRESCRIBED PEDIATRIC EXTENDED 3
CARE CENTER; AND FOR RELATED PURPOSES. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 5
SECTION 1. Section 41-125-19, Mississippi Code of 1972, is 6
amended as follows: 7
41-125-19. (1) To carry out the intention of the 8
Legislature to provide safe and sanitary facilities and healthful 9
programs, the licensing agency shall adopt and publish rules to 10
implement the provisions of this chapter, which shall include 11
reasonable and fair standards. Any conflict between these 12
standards and those that may be set forth in local, county or city 13
ordinances shall be resolved in favor of those having statewide 14
effect. Those standards shall relate to: 15
(a) The assurance that PPEC services are family 16
centered and provide individualized medical, developmental and 17
family training services. 18

(b) The maintenance of PPEC centers, based upon the 19
size of the structure and number of children, relating to 20
plumbing, heating, lighting, ventilation and other building 21
conditions, including adequate space, which will ensure the 22
health, safety, comfort and protection from fire of the children 23
served. 24
(c) The appropriate provisions of the most recent 25
edition of the "Life Safety Code" shall be applied. 26
(d) The number and qualifications of all personnel who 27
have responsibility for the care of the children served. 28
(e) All sanitary conditions within the PPEC center and 29
its surroundings, including water supply, sewage disposal, food 30
handling and general hygiene, and maintenance thereof, which will 31
ensure the health and comfort of children served. 32
(f) Programs and basic services promoting and 33
maintaining the health and development of the children served and 34
meeting the training needs of the children's parents or legal 35
guardians. 36
(g) Supportive, contracted, other operational and 37
transportation services. However, the licensing agency may not 38
require physical therapists to have prior work experience in order 39
to work at a PPEC center. 40
(h) Maintenance of appropriate medical records, data 41
and information relative to the children and programs. Those 42

records shall be maintained in the facility for inspection by the 43
agency. 44
(2) The licensing agency shall adopt rules to ensure that: 45
(a) No child attends a PPEC center for more than twelve 46
(12) hours within a twenty-four-hour period. 47
(b) No PPEC center provides services other than those 48
provided to medically or technologically dependent children. 49
SECTION 2. This act shall take effect and be in force from 50
and after July 1, 2026. 51
