HOUSE BILL NO. 619
AN ACT TO AMEND SECTION 63-3-519, MISSISSIPPI CODE OF 1972, 1
TO AUTHORIZE THE SHERIFF AND HIS OR HER DEPUTIES IN ANY COUNTY 2
HAVING A POPULATION OF 150,000 OR MORE TO USE RADAR SPEED 3
DETECTION EQUIPMENT UPON THE PUBLIC STREETS, ROADS AND HIGHWAYS OF 4
THE COUNTY LYING OUTSIDE THE LIMITS OF ANY INCORPORATED 5
MUNICIPALITY AND EXCLUDING ANY INTERSTATE HIGHWAY; TO PROVIDE THAT 6
CERTAIN MEASURES MAY BE TAKEN BY THE DEPARTMENT OF PUBLIC SAFETY 7
IF CERTAIN ABUSE IS REPORTED CONCERNING THE USE OF SUCH EQUIPMENT; 8
TO PROVIDE THAT FUNDS GENERATED BY THE USE OF RADAR SPEED 9
DETECTION EQUIPMENT SHALL BE USED TO FUND SCHOOL RESOURCE OFFICERS 10
WITHIN A COUNTY; AND FOR RELATED PURPOSES. 11
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 12
SECTION 1. Section 63-3-519, Mississippi Code of 1972, is 13
amended as follows: 14
63-3-519. (1) It shall be unlawful for any person or peace 15
officer or law enforcement agency, except the Mississippi Highway 16
Safety Patrol, to purchase or use or allow to be used any type of 17
radar speed detection equipment upon any public street, road or 18
highway of this state. However, such equipment may be used: 19
(a) By municipal law enforcement officers within a 20
municipality having a population of two thousand (2,000) or more 21
according to the latest or a previous federal census upon the 22

public streets of the municipality, but in no case where the 23
latest federal census population for the municipality is less than 24
one thousand five hundred (1,500); 25
(b) By any college or university campus police force 26
within the confines of any campus wherein more than two thousand 27
(2,000) students are enrolled; 28
(c) By municipal law enforcement officers in any 29
municipality having a population in excess of fifteen thousand 30
(15,000) according to the latest federal census on federally 31
designated highways lying within the corporate limits. 32
(d) By municipal law enforcement officers upon the 33
public streets of any incorporated municipality (i) where the 34
county seat is located in the municipality and (ii) where there is 35
a public community college located in the municipality. 36
(e) (i) By the sheriff and deputy sheriffs of any 37
county having a population of one hundred fifty thousand (150,000) 38
or more according to the 2020 federal decennial census, on any 39
public county road or highway within the county, excluding any 40
interstate or state highway that is located outside the corporate 41
limits of any incorporated municipality. Before the sheriff and 42
deputy sheriffs of any such county exercises the authority 43
authorized under this paragraph (e), the board of supervisors of 44
the county must authorize the use of radar speed detection devices 45
by order duly adopted and entered upon its minutes. 46

use by sheriffs and deputies of certain
counties.
(ii) If the Department of Public Safety determines 47
that the authority granted under this paragraph (e) is being 48
abused after such purported abuse is reported and investigated by 49
the department, then the commissioner of the department is 50
authorized to notify the county of the abuse and the radar speed 51
detection devices may be removed from the offending sheriff and 52
his or her deputies. 53
(iii) Any funds generated under this paragraph by 54
the use of radar speed detection devices shall be used by counties 55
solely for school safety by funding school resource officers or 56
law enforcement officers assigned to schools within the county. 57
(2) The Mississippi Highway Safety Patrol shall be 58
immediately notified by municipal or county law enforcement of any 59
road blockages or emergencies occurring on any federally 60
designated limited-access highways lying within the corporate 61
limits. 62
SECTION 2. This act shall take effect and be in force from 63
and after July 1, 2026. 64
