AN ACT MAKING AN APPROPRIATION FROM SEVERAL SPECIAL FUNDS TO 1
THE DEPARTMENT OF FINANCE AND ADMINISTRATION FOR THE PURPOSE OF 2
MAKING GRANTS UNDER THE MISSISSIPPI HOSPITAL RECOVERY TRUST 3
PROGRAM CREATED BY HOUSE BILL NO. , 2026 REGULAR SESSION, FOR THE 4
PERIOD BEGINNING UPON THE PASSAGE OF THIS ACT AND ENDING JUNE 30, 5
2027. 6
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 7
SECTION 1. The following sum, or so much of it as may be 8
necessary, is appropriated out of any money in the Health Care 9
Expendable Fund not otherwise appropriated, to the Department of 10
Finance and Administration for the purpose of making grants under 11
the Mississippi Hospital Recovery Trust Program created by House 12
Bill No.___, 2026 Regular Session, for the period beginning upon 13
the passage of this act and ending June 30, 2027.................. 14

SECTION 2. The following sum, or so much of it as may be 16
necessary, is appropriated out of any money in the State BP 17
Settlement Fund not otherwise appropriated, to the Department of 18
Finance and Administration for the purpose of making grants under 19
the Mississippi Hospital Recovery Trust Program created by House 20

SECTION 3. The following sum, or so much of it as may be 24
necessary, is appropriated out of any money in the Coronavirus 25
State Fiscal Recovery Fund not otherwise appropriated, to the 26
Department of Finance and Administration for the purpose of making 27
grants under the Mississippi Hospital Recovery Trust Program 28
created by House Bill No.__, 2026 Regular Session, for the period 29
beginning upon the passage of this act and ending June 30, 2027... 30

SECTION 4. (1) As used in this section and Section 5 of 32
this act, the term "department" means the Department of Finance 33
and Administration. 34
(2) The department shall not disburse any funds 35
appropriated under Section 3 of this act to any recipient without 36
first: (a) making an individualized determination that the 37
expenditure sought is, in the department's independent judgment, 38
for necessary expenditures eligible under Section 602 of the 39
federal Social Security Act as added by Section 9901 of the 40
federal American Rescue Plan Act of 2021 (ARPA) and its 41
implementing guidelines, guidance, rules, regulations and/or other 42
criteria, as may be amended or supplemented from time to time, by 43
the United States Department of the Treasury; and (b) determining 44
that the recipient has not received and will not receive 45

reimbursement for the expense in question from any source of 46
funds, including insurance proceeds, other than those funds 47
provided under Section 602 of the federal Social Security Act as 48
added by Section 9901 of ARPA. In addition, the department shall 49
ensure that all funds appropriated under this act are disbursed in 50
compliance with the Single Audit Act (31 USC Sections 7501-7507) 51
and the related provisions of the Uniform Guidance, 2 CFR Section 52
200.303 regarding internal controls, Sections 200.330 through 53
200.332 regarding sub-recipient monitoring and management, and 54
subpart F regarding audit requirements. 55
SECTION 5. (1) As a condition of receiving and expending 56
the funds appropriated to the department under Section 3 of this 57
act, the department shall certify to the Department of Finance and 58
Administration that each expenditure of the funds appropriated to 59
the department under Section 3 of this act complies with the 60
guidelines, guidance, rules, regulations and/or other criteria, as 61
may be amended from time to time, of the United States Department 62
of the Treasury regarding the use of monies from the Coronavirus 63
State Fiscal Recovery Fund established by ARPA. 64
(2) If the Office of Inspector General of the United States 65
Department of the Treasury, or the Office of Inspector General of 66
any other federal agency having oversight over the use of monies 67
from the Coronavirus State Fiscal Recovery Fund established by 68
ARPA (a) determines that the department or recipient has expended 69
or otherwise used any of the funds appropriated to the department 70

under Section 3 of this act for any purpose that is not in 71
compliance with the guidelines, guidance, rules, regulations 72
and/or other criteria, as may be amended from time to time, of the 73
United States Department of the Treasury regarding the use of 74
monies from the Coronavirus State Fiscal Recovery Fund established 75
by ARPA, and (b) the State of Mississippi is required to repay the 76
federal government for any of those funds that the Office of the 77
Inspector General determined were expended or otherwise used 78
improperly by the department or recipient, then the department or 79
recipient that expended or otherwise used those funds improperly 80
shall be required to pay the amount of those funds to the State of 81
Mississippi for repayment to the federal government. 82
SECTION 6. The money appropriated by this act shall be paid 83
by the State Treasurer out of any money in the State Treasury to 84
the credit of the proper fund or funds as set forth in this act, 85
upon warrants issued by the State Fiscal Officer; and the State 86
Fiscal Officer shall issue his or her warrants upon requisitions 87
signed by the proper person, officer or officers in the manner 88
provided by law. 89
SECTION 7. This act shall take effect and be in force from 90
and after its passage. 91
