AN ACT TO AMEND SECTION 83-17-251, MISSISSIPPI CODE OF 1972, TO REQUIRE THE COMMISSIONER OF INSURANCE TO MAINTAIN A DATABASE OF INSURANCE PRODUCER LICENSEES AGED 65 OR OLDER WHO HAVE SUBMITTED AN AFFIDAVIT ATTESTING TO THEIR QUALIFICATIONS TO BE EXEMPT FROM CONTINUING EDUCATION REQUIREMENTS; TO PROHIBIT A LICENSEE FROM BEING REQUIRED TO SUBMIT AN AFFIDAVIT WITH SUBSEQUENT APPLICATIONS FOR LICENSE RENEWAL IF THE APPLICANT HAS NOT HAD AN INTERRUPTION TO CONTINUOUS EXPERIENCE AS A LICENSED INSURANCE PRODUCER; AND FOR RELATED PURPOSES.

FOR LICENSE RENEWAL IF THE APPLICANT HAS NOT HAD AN INTERRUPTION 7
TO CONTINUOUS EXPERIENCE AS A LICENSED INSURANCE PRODUCER; AND FOR 8
RELATED PURPOSES. 9
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 10
SECTION 1. Section 83-17-251, Mississippi Code of 1972, is 11
amended as follows: 12
83-17-251. (1) Every individual seeking to be licensed as 13
an insurance producer in the State of Mississippi, as a condition 14
of issuance of an original license, must furnish the Commissioner 15
of Insurance certification on a form prescribed by the 16
commissioner that he or she has completed an approved prelicensing 17
course of study for the line of insurance requested. 18
(2) The prelicensing course of study hours shall consist of 19
twenty (20) hours of approved prelicensing education courses per 20
line of authority. The Commissioner of Insurance shall determine 21

the content requirements for each prelicensing course of study. 22
The prelicensing educational requirements of this section shall 23
not apply to: 24
(a) An individual that is exempt from taking the 25
written examination as provided in Section 83-17-39(1) and Section 26
83-17-67. 27
(b) An individual who has received a bachelor's degree 28
with major coursework in insurance from an accredited institution 29
of higher learning. 30
(c) An individual holding a current and valid CEBS, 31
CHFC, CIC, CFP, CLU, FLMI, LUTCF designation is exempt for the 32
life line of authority. 33
(d) An individual holding a current and valid RHU, 34
CEBS, REBC, HIA designation is exempt for the accident and health 35
or sickness line of authority. 36
(e) An individual holding a current and valid AAI, ARM, 37
CIC, CPCU designation is exempt for the property and casualty 38
lines of authority. 39
(f) Limited lines insurance producer and limited lines 40
credit insurance producer as defined in Section 83-17-53. 41
(g) An individual that is seeking licensure for the 42
variable life and variable annuity products line of authority 43
only. 44
(h) An individual that is seeking licensure for the 45
life line of authority only. 46

(3) Every individual seeking renewal of an insurance 47
producer license, which has been in effect for a term of eighteen 48
(18) months or less shall satisfactorily complete twelve (12) 49
hours of study in approved continuing education courses. Every 50
individual seeking renewal of an insurance producer license, which 51
has been in effect for a term of more than eighteen (18) months 52
shall satisfactorily complete twenty-four (24) hours of study in 53
approved continuing education courses, of which three (3) hours 54
shall have a course concentration in ethics. 55
(4) The continuing educational requirements of this section 56
shall not apply to: 57
(a) Any individual that is exempt from taking the 58
written examination as provided in Section 83-17-39(1)(b), (c), 59
(e) and (g); 60
(b) Any limited lines producer or limited lines credit 61
insurance producer; 62
(c) A person not a resident of this state who meets the 63
continuing educational requirement in the state in which such 64
person resides and Mississippi has a reciprocal agreement with 65
that state; 66
(d) Nonactive agents as defined in Section 83-17-1; or 67
(e) Any individual who is sixty-five (65) years of age 68
or older and who has been licensed as an insurance producer for a 69
continuous period of twenty-five (25) years or more * * *, as 70
evidenced by the one-time submission of an affidavit, under oath, 71

on a form prescribed by the commissioner, signed by the licensee 72
attesting to satisfaction of the age, licensing and experience 73
requirements of this paragraph (e). The commissioner shall 74
maintain a database of each licensee who has submitted an 75
affidavit pursuant to this paragraph which the commissioner has 76
accepted as satisfactory. A licensee whose affidavit has been 77
accepted by the commissioner as satisfactory who does not have an 78
interruption to continuous experience as a licensed insurance 79
producer, as required under this paragraph, may not be required to 80
submit an affidavit when subsequently applying for license renewal 81
in future years. 82
SECTION 2. This act shall take effect and be in force from 83
and after July 1, 2026. 84
