A CONCURRENT RESOLUTION PROPOSING AMENDMENTS TO SECTIONS 34, 1
35, 41 AND 42, MISSISSIPPI CONSTITUTION OF 1890, TO PROVIDE THAT A 2
PERSON WHO IS ELECTED AFTER JULY 1, 2026, AND WHO HAS SERVED FOR 3
THREE CONSECUTIVE FOUR-YEAR TERMS IN THE MISSISSIPPI HOUSE OF 4
REPRESENTATIVES OR THE MISSISSIPPI SENATE SHALL NOT BE ELIGIBLE TO 5
SERVE AGAIN IN THAT OFFICE. 6
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF 7
MISSISSIPPI, That the following amendments to the Mississippi 8
Constitution of 1890 are proposed to the qualified electors of the 9
state: 10
I. 11
Amend Section 34, Mississippi Constitution of 1890, to read 12
as follows: 13
"Section 34. The house of representatives shall consist of 14
members chosen every four (4) years by the qualified electors of 15
the several counties and representative districts. A person 16
elected as a member of the House of Representatives is eligible to 17
succeed himself or herself in office; however, after serving three 18
(3) full and consecutive four-year terms in the House of 19
Representatives, he or she shall not be eligible to serve again in 20

that office. This limitation on the number of terms shall apply 21
to terms of office beginning on or after July 1, 2026." 22
II. 23
Amend Section 35, Mississippi Constitution of 1890, to read 24
as follows: 25
"Section 35. The senate shall consist of members chosen 26
every four years by the qualified electors of the several 27
districts. A person elected as a member of the Senate is eligible 28
to succeed himself or herself in office; however, after serving 29
three (3) full and consecutive four-year terms in the Senate, he 30
or she shall not be eligible to serve again in that office. This 31
limitation on the number of terms shall apply to terms of office 32
beginning on or after July 1, 2026." 33
III. 34
Amend Section 41, Mississippi Constitution of 1890, to read 35
as follows: 36
"Section 41. No person shall be a member of the House of 37
Representatives who shall not have attained the age of twenty-one 38
(21) years, and who shall not be a qualified elector of the state, 39
and who shall not have been a resident citizen of the state for 40
four (4) years, and within the district such person seeks to serve 41
for two (2) years, immediately preceding his election, and who has 42
reached the term limits defined in Section 34, Mississippi 43
Constitution of 1890. The seat of a member of the House of 44

Representatives shall be vacated on his removal from the district 45
from which he was elected." 46
IV. 47
Amend Section 42, Mississippi Constitution of 1890, to read 48
as follows: 49
"Section 42. No person shall be a senator who shall not have 50
attained the age of twenty-five (25) years, who shall not have 51
been a qualified elector of the state four (4) years, and who 52
shall not be an actual resident of the district or territory he 53
may be chosen to represent for two (2) years before his election, 54
and who has reached the term limits defined in Section 35, 55
Mississippi Constitution of 1890. The seat of a senator shall be 56
vacated upon his removal from the district from which he was 57
elected." 58
BE IT FURTHER RESOLVED, That these proposed amendments shall 59
be submitted by the Secretary of State to the qualified electors 60
at an election to be held on the first Tuesday after the first 61
Monday of November 2026, as provided by Section 273 of the 62
Constitution and by general law, with the amendments in this 63
resolution being voted on as one (1) amendment since the proposed 64
amendments pertain to one (1) subject. 65
BE IT FURTHER RESOLVED, That the explanation of this proposed 66
amendment for the ballot shall read as follows: "This proposed 67
constitutional amendment provides that a person who is elected 68
after July 1, 2026, and who has served for three consecutive 69
