A CONCURRENT RESOLUTION CREATING A JOINT LEGISLATIVE STUDY 1
COMMITTEE TO STUDY THE UNINTENDED IMPACT OF WIND TURBINE USAGE IN 2
AGRICULTURE AND TO MAKE RECOMMENDATIONS BASED ON THE STUDY TO THE 3
LEGISLATURE. 4
WHEREAS, the Legislature finds the installation and usage of 5
wind turbines are potentially having unintended impacts on 6
surrounding properties, the temperature, the ability to adequately 7
farm certain neighboring agricultural products due to wind tower 8
placing, the aquifer, agricultural aviation pilots, and migratory 9
birds; and 10
WHEREAS, these potentially unintended impacts have created a 11
need to study the impact of wind turbine usage in agriculture: 12
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF 13
REPRESENTATIVES OF THE STATE OF MISSISSIPPI, THE SENATE CONCURRING 14
THEREIN, That: 15
(1) There is created a joint legislative study committee for 16
the purpose of studying the impact of wind turbine usage in 17
agriculture. The study committee shall comprehensively research 18
these potential issues and report back to the Legislature with the 19

committee's recommendations and the appropriate legislation to 20
enact those recommendations into law. 21
(2) The study committee shall be comprised of the following 22
members or a designee appointed from the membership of the 23
respective committee by a chairman: 24
(a) The Chairman of the Senate Agriculture Committee; 25
(b) The Chairman of the House Agriculture Committee; 26
(c) The Chairman of the Senate Energy Committee; 27
(d) The Chairman of the House Energy Committee; 28
(e) The Chairman of the House Public Utilities 29
Committee; 30
(f) The Chairman of the Senate Wildlife, Fisheries and 31
Parks Committee; and 32
(g) The Chairman of the House Wildlife, Fisheries and 33
Parks Committee. 34
(3) The study committee shall meet to discuss and provide 35
recommendations and proposed legislation for the following topics: 36
(a) The setbacks that are necessary to prevent wind 37
turbines from causing property right infringement issues due to 38
the potential displacement of fertilizers, herbicides, pesticides, 39
and other airborne farming substances that could be displaced to 40
neighboring properties due to the gusts created by wind turbines; 41
(b) The impact wind turbine installation is having on 42
the aquifer and other nearby water sources; 43

(c) Any potential safety concerns or issues that wind 44
turbines cause agricultural aviation pilots to experience; 45
(d) Potential endangerment of migratory birds and the 46
correlation to the disruption of the Mississippi Flyway; 47
(e) Adequate decommissioning funds to be set aside for 48
wind turbines in the event that they are no longer in use; and 49
(f) Any other information deemed relevant and necessary 50
to accomplish the tasks assigned in this subsection. 51
(4) To assist the study committee in gaining sufficient 52
information necessary to carry out its tasks, the study committee 53
may invite a person representing the following entities to present 54
information at one or more meetings of the committee: 55
(a) The Public Service Commission; 56
(b) The Mississippi Department of Environmental 57
Quality; 58
(c) The Department of Agriculture and Commerce; 59
(d) The Department of Agriculture at Mississippi State 60
University; 61
(e) The President of the Mississippi Farm Bureau 62
Federation, or his or her designee; and 63
(f) The President of the Mississippi Agricultural 64
Aviation Association, or his or her designee. 65
(5) At the first meeting of the study committee, the 66
committee shall elect from among its members a chairman and any 67
other officers determined to be necessary. The committee shall 68

adopt rules for transacting business and keeping records. In the 69
adoption of rules, resolutions and reports, and in the election of 70
a chairman and other officers determined to be necessary, an 71
affirmative vote of a majority of the members present is required. 72
A majority of the members of the study committee constitutes a 73
quorum. 74
(6) Members of the study committee shall be reimbursed in 75
the same manner as for attending out-of-session committee 76
meetings. 77
(7) The Legislature shall provide the staff and other 78
support necessary for the study committee to perform its duties. 79
(8) To effectuate the purposes of this act, any department, 80
division, board, bureau, committee, institution or agency of the 81
state, or any political subdivision thereof, shall provide, at the 82
request of the chairman of the study committee, the facilities, 83
assistance, information and data needed to enable the study 84
committee to carry out its duties. 85
(9) The study committee shall develop and report its 86
findings and proposed legislation to the Legislature before 87
December 1, 2026. 88
(10) The study committee shall be dissolved on or before 89
January 1, 2027. 90
