HOUSE RESOLUTION NO. 152

A RESOLUTION URGING THE STATE OF MISSISSIPPI TO ACKNOWLEDGE 1
AND ADOPT THE TEMPORARY WORKERS' BILL OF RIGHTS FOR THE BETTERMENT 2
OF THE STATE. 3
WHEREAS, temporary work is often unregulated, resulting in 4
widespread abuse, including unreasonably long term job assignments 5
without benefits or equal opportunities for fair and gainful 6
employment; and 7
WHEREAS, the immediate incorporation and enforcement of the 8
following guidelines in companies and temporary agencies across 9
the State of Mississippi shall be in the best interest of the 10
state: 11
(a) Ensure temporary workers are paid a living wage; 12
(b) Ensure temporary workers receive basic information 13
regarding their work assignments such as work hours, rate of pay 14
and the contact name of their worksite employer; 15
(c) Prohibit temporary staffing agencies from charging 16
temporary workers for performing background checks and drug tests; 17

(d) Ensure temporary workers receive the same basic 18
safety training as other employees, and require that temporary 19
workers are made aware of injury reporting guidelines and to 20
inform temporary workers of hazards associated with their worksite 21
in an effort to lower high rates of injury among temporary 22
workers; 23
(e) Prohibit the use of forced arbitration agreements 24
and non-compete agreements by temporary staffing agencies and host 25
employers; 26
(f) Limit the use of conversion fees that hinder the 27
future job prospects of temporary workers by either prohibiting 28
host employers from hiring temporary workers directly or requiring 29
the host employer to pay the staffing agency a fee; 30
(g) Address discrimination in the temporary staffing 31
agency industry; 32
(h) Require temporary staffing agencies to publish 33
critical data of each agency's employment practices; 34
(i) Require employers to offer full-time, permanent 35
employment after ninety (90) days of temporary workers assignment; 36
(j) Prohibit temporary work assignments from exceeding 37
a ninety-day period; provided, however, exceptions shall be made 38
for long-term assignments where the assignment is made to cover 39
extended medical leaves, e.g., replacing permanent employees who 40
are out on maternity/paternity leave or recovering from 41
catastrophic illnesses and for such exceptions, those assigned to 42

cover these special circumstances, shall at the end of one hundred 43
eighty (180) days be offered full-time permanent positions with 44
benefits; and 45
(k) Prohibit temporary work assignments from exceeding a 46
period of ninety (90) days, and after ninety (90) days, the 47
temporary employee shall be offered full-time permanent employment 48
with benefits. 49
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF 50
REPRESENTATIVES OF THE STATE OF MISSISSIPPI, That we do hereby 51
urge the State of Mississippi to acknowledge and adopt the 52
Temporary Workers' Bill of Rights for the betterment of the state. 53
