A JOINT RESOLUTION TO AMEND JOINT RESOLUTION NO. 202, 2025 1
REGULAR SESSION, TO PROVIDE THAT IN THE EVENT THE UNITED STATES 2
SUPREME COURT ISSUES A FINAL DECISION IN THE LOUISIANA 3
CONGRESSIONAL REDISTRICTING PLAN HOLDING THAT THE PLAN VIOLATES 4
THE U.S. CONSTITUTION OR IS NONJUSTICIABLE, THEN THE SENATE 5
LEGISLATIVE DISTRICTS AS PRESENTLY SET OUT SHALL BE SUPERSEDED BY 6
JOINT RESOLUTION NO. 202, 2022 REGULAR SESSION; AND FOR RELATED 7
PURPOSES. 8
WHEREAS, in its July 2, 2024, opinion, the United States 9
District Court for the Southern District of Mississippi, in the 10
case styled Mississippi State Conf. of the NAACP v. State Bd. of 11
Election Comm'rs., No. 3:22-CV-734, concluded that the Plaintiffs 12
had shown violations of Section 2 of the Voting Rights Act. 13
Specifically, the Court found the Plaintiffs had shown that two 14
(2) Senate districts did not satisfy the framework of Thornburg v. 15
Gingles, 478 U.S. 30 (1986); and 16
WHEREAS, to remedy those violations, the Court recognized 17
that redistricting is primarily the duty and responsibility of the 18
State through its Legislature or other body, rather than a federal 19
court, and further stated that the Mississippi Legislature would 20

be given an opportunity to create new districts, and ultimately 21
elections would be needed in all reformed districts; and 22
WHEREAS, on July 18, 2024, after considering options, the 23
Court gave the Mississippi Legislature until the conclusion of the 24
2025 Regular Session to develop a remedial plan; and 25
WHEREAS, the Mississippi Legislature has reviewed the orders 26
of the Court in the above-styled case and has prepared amendments 27
to the Mississippi State Senate Redistricting plan adopted in 28
2022, thereby creating two (2) new State Senate Districts wherein 29
minorities will have an opportunity to elect a candidate of their 30
choice while limiting the ripple effect to existing districts as 31
much as reasonably possible; NOW, THEREFORE, 32
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF 33
MISSISSIPPI, That Joint Resolution No. 202, 2025 Regular Session, 34
is amended as follows: 35

Chairman and Vice Chairman of the Standing Joint Legislative 519
Committee on Reapportionment shall file with the Secretary of 520
State the Split Precinct Block List developed in conjunction with 521
the plan contained in this joint resolution that details the 522
portions of the partial or split precincts, which are contained 523
within a district by census block number, and such document duly 524
filed with the Secretary of State is hereby incorporated into and 525

BE IT FURTHER RESOLVED, That the boundaries of the senatorial 528
districts described above shall be: 529

BE IT FURTHER RESOLVED, That: 538
(1) This joint resolution shall be liberally construed to 539
effectuate the purposes thereof and to redistrict the Senate 540
districts of this state in compliance with constitutional 541
requirements. It is the intent of the Legislature that this joint 542
resolution, and the districts described herein, completely 543
encompass all the area within the state. It is also intended that 544
such districts contain all the inhabitants in this state. It is 545
further intended that the redistricting provided for in this joint 546
resolution results in the creation of districts that are as close 547
to equal in population as permissible under law. It is also 548
intended that no district shall contain any of the area included 549
within the description of another district. 550
(2) If the districts described in this joint resolution do 551
not carry out the purposes thereof because of unintentional 552
omissions, duplications, overlapping areas, erroneous 553
nomenclature, lack of adequate maps or descriptions of political 554
subdivisions, wards or other divisions thereof, or of their 555
boundary lines, then the Secretary of State, at the request of the 556
Chair or Vice Chairman of the Standing Joint Legislative Committee 557
on Reapportionment shall, by order, correct such omissions, 558
overlaps, erroneous nomenclature or other defects in the 559

description of districts so as to accomplish the purposes and 560
objectives of this joint resolution. 561
(3) In promulgating such orders, the Secretary of State, in 562
addition to achieving equality in the population of districts as 563
permissible under law and ensuring that all areas of the state 564
are completely and accurately encompassed in such districts, shall 565
be guided by the following standards: 566
(a) In any instance in which there is a conflict 567
between the description of a district as provided in this joint 568
resolution and the map of the Senate districts developed by the 569
Standing Joint Legislative Committee on Reapportionment in 570
conjunction with the adopted redistricting plan, the map shall 571
control; however, in instances in which the map is inconclusive, 572
the criteria provided in paragraphs (b) through (f) of this 573
subsection shall control any dispute or issue regarding the 574
composition of any Senate district; 575
(b) Gaps in the description of a district shall be 576
completed in a manner that results in a total description of the 577
district that is consonant with the description of adjacent 578
districts and results in complete contiguity of districts; 579
(c) Areas of the state included within the descriptions 580
of more than one (1) district shall be allocated to the district 581
having the lowest population; 582

(d) Areas of the state not included within the 583
descriptions of any district shall be allocated to the adjacent 584
district having the lowest population; 585
(e) In the event that the area subject to corrected 586
description or allocation as provided in paragraphs (b), (c) and 587
(d) of this subsection is of such size or contains such population 588
that its inclusion as a unit in any district would result in 589
substantial disparity in the size, shape or population of the 590
district, then the Secretary of State may allocate portions of the 591
area to two (2) or more districts; and 592
(f) In any allocation of area or correction of 593
descriptions made pursuant to this joint resolution, the Secretary 594
of State shall, consistent with the foregoing standards, preserve 595
the contiguity and compactness of districts and avoid the 596
unnecessary division of political subdivisions. 597
(4) Copies of such orders shall be filed by the Secretary of 598
State in his office and in the offices of the affected 599
commissioners of election and registrars. The Secretary of State 600
may adopt reasonable rules regulating the procedure for 601
applications for orders under this joint resolution in the manner 602
of serving and filing a notice or copy of orders relating thereto. 603
Upon the filing of an order, the description of any affected 604
district shall be deemed to have been corrected in the manner 605
provided in such order to the full extent as if the correction had 606

BE IT FURTHER RESOLVED, That the Standing Joint Legislative 609
Committee on Reapportionment is directed to provide all 610
information necessary to assist the counties in identifying the 611
boundaries of the districts described in this joint resolution. 612
BE IT FURTHER RESOLVED, That the redistricting contained in 613
this joint resolution shall supersede any prior redistricting, and 614
any prior redistricting shall be null and void upon the date this 615
joint resolution is effectuated. 616
BE IT FURTHER RESOLVED, That the Chairman and Vice Chairman 617
of the Standing Joint Legislative Committee on Reapportionment 618
shall file copies of this plan with the Mississippi Department of 619
Archives and History, the Secretary of State, the Clerk of the 620
Mississippi House of Representatives, and the Secretary of the 621
Mississippi State Senate. 622
BE IT FURTHER RESOLVED, That if any paragraph, sentence, 623
clause, phrase or any part of this joint resolution is declared to 624
be unconstitutional or void, or if for any reason is declared to 625
be invalid or of no effect, the remaining paragraphs, sentences, 626
clauses, phrases or parts thereof shall be in no manner affected 627
thereby, but shall remain in full force and effect. 628
BE IT FURTHER RESOLVED, That the redistricting of House of 629
Representatives districts and Senate districts shall be deemed to 630
be separate from each other. The invalidity of the districts of 631
