AN ACT TO ENACT THE MISSISSIPPI MANDATORY BOND REVIEW LAW; TO 1

PRETRIAL DETENTION IN MISSISSIPPI; TO REQUIRE THAT CERTAIN FACTORS 5
ARE CONSIDERED IN DETERMINING BOND; TO REQUIRE NOTIFICATION OF 6
EACH INDIVIDUAL'S DEFENSE COUNSEL; AND FOR RELATED PURPOSES. 7
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 8
SECTION 1. (1) This section shall be known and may be cited 9
as the "Mississippi Mandatory Bond Review Law." 10
(2) In addition to the procedures of Rule 8 of the 11
Mississippi Rules of Criminal Procedure, the senior circuit court 12
judge in each circuit court district, in conjunction with the 13
district attorney, shall ensure that the following procedures are 14
implements for all individuals held within pretrial detention in 15
Mississippi: 16
(a) An initial bond determination shall occur within 17
seventy-two (72) hours of arrest. 18

(b) A bond review hearing shall be held within fourteen 19
(14) days of detention for any individual who remains 20
incarcerated. 21
(c) Periodic bond reviews shall occur for incarcerated 22
persons within every forty-five (45) days after the bond review 23
required under paragraph (b). 24
(3) In determining bond, the court shall consider the 25
factors set forth in Rule 8.2 of the Mississippi Rules of Criminal 26
Procedure. There shall be a presumption of release on 27
recognizance or bond unless specific findings support continued 28
detention. 29
(4) For bond reviews required under subsection (1) of this 30
section, defense counsel shall be notified and may participate in 31
all reviews. Written findings shall be entered into the record 32
when bond is denied or, at a review hearing, the amount of bond is 33
not reduced. 34
SECTION 2. This act shall take effect and be in force from 35
and after its passage. 36
