SENATE BILL NO. 2120
AN ACT TO REQUIRE CERTAIN GROUP HEALTH PLANS AND HEALTH 1
INSURANCE INSURERS OFFERING GROUP OR INDIVIDUAL HEALTH INSURANCE 2
TO INCLUDE COVERAGE FOR ANNUAL PROSTATE CANCER SCREENINGS 3
PERFORMED IN ACCORDANCE WITH THE MOST RECENT NATIONAL 4
COMPREHENSIVE CANCER NETWORK GUIDELINES FOR MEN WITH A HIGH RISK 5
FOR PROSTATE CANCER; TO PROHIBIT GROUP HEALTH PLANS AND HEALTH 6
INSURANCE INSURERS OFFERING GROUP OR INDIVIDUAL HEALTH INSURANCE 7
TO INDIVIDUALS ENROLLED UNDER SUCH PLANS FROM IMPOSING 8
COST-SHARING REQUIREMENTS FOR ANNUAL PROSTATE CANCER SCREENINGS; 9
TO EXEMPT CERTAIN PLANS FROM THE REQUIREMENT TO INCLUDE SUCH 10
COVERAGE; TO DEFINE TERMS; AND FOR RELATED PURPOSES. 11
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 12
SECTION 1. (1) As used in this section, the following words 13
and phrases shall have the meanings ascribed herein unless the 14
context clearly indicates otherwise: 15
(a) "Cost-sharing requirement" means a deductible, 16
coinsurance, copayment or similar out-of-pocket expense. 17
(b) "Men with a family history of prostate cancer" 18
means men who have a relative within the first-degree of kinship: 19
(i) Who has been diagnosed with prostate cancer; 20
(ii) Who developed prostate cancer; 21
(iii) Whose death was a result of prostate cancer; 22

(iv) Who has been diagnosed with a cancer known to 23
be associated with an increased risk of prostate cancer; or 24
(v) Who has a genetic alteration known to be 25
associated with an increased risk of prostate cancer. 26
(c) "Men with a high risk for prostate cancer" means 27
the following: 28
(i) Men with a family history of prostate cancer 29
who are between forty (40) and forty-nine (49) years of age; 30
(ii) Men with risk factors as defined by the most 31
recent National Comprehensive Cancer Network Guidelines who are 32
between forty (40) and forty-nine (49) years of age; 33
(iii) Men who are fifty (50) years of age and 34
older; and 35
(iv) Other men who exhibit potential signs or 36
symptoms of prostate cancer, as determined by a physician. 37
(d) "Prostate cancer screening" means a medically 38
necessary and appropriate examination of the prostate performed in 39
accordance with the most recent National Comprehensive Cancer 40
Network Guidelines, including, but not limited to, such an 41
examination using the prostate-specific antigen test or digital 42
rectal exam, that is: 43
(i) Used to detect and diagnose prostate cancer; 44
and 45
(ii) Based on personal or family medical history 46
or additional prostate cancer risk factors. 47

certain group health plans and insurers to cover
without cost-sharing for high-risk men.
(2) Any group health plan or a health insurance insurer 48
offering group or individual health insurance shall include 49
coverage for annual prostate cancer screenings for men with a high 50
risk for prostate cancer. 51
(3) A group health plan or a health insurance issuer 52
offering group or individual health insurance coverage that 53
provides coverage for annual prostate cancer screenings required 54
under subsection (2) of this section to an individual enrolled 55
under such plan shall not impose any cost-sharing requirements for 56
those screenings. 57
(4) Except for cancer policies, nothing in this section 58
shall apply to accident-only, specified disease, hospital 59
indemnity, Medicaid, Medicare supplement, long-term care or 60
limited benefit health insurance policies, or to the State and 61
School Employees' Health Insurance Plan policies. 62
SECTION 2. This act shall take effect and be in force from 63
and after July 1, 2026. 64
