BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 12
SECTION 1. (1) As used in this section, the following 13
definitions apply unless a contrary meaning is evident from the 14
context: 15
(a) "Break/fix rate" means the percentage obtained by 16
dividing the number of school technology devices reported as 17
malfunctioning or needing repair due to physical damage, hardware 18
failure, or other breakage incidents prior to the stated life 19
cycle period, not covered by insurance or a policy plan period, by 20
the total number of school technology devices in operation during 21
that period. 22

(b) "Public school unit" means a school district or a 23
charter school. 24
(c) "School board" means the governing board of a 25
public school unit. 26
(d) "School technology device" means any electronic or 27
computerized equipment provided for educational purposes in a 28
public school unit, including computers, tablets, interactive 29
whiteboards, and similar digital devices. 30
(2) The State Board of Education shall adopt rules requiring 31
all school boards to evaluate the following when acquiring 32
technology, computer hardware, and software: 33
(a) The long term cost of ownership, including costs of 34
repairing the technology, computer hardware, or software; 35
(b) Any flexibility for innovation during the life of 36
the technology, computer hardware, or software; and 37
(c) Any anticipated resale or salvage value at the end 38
of the target life cycle for the technology, computer hardware, or 39
software based on the average resale or salvage value of similar 40
technology, computer hardware, or software as a percentage of the 41
initial cost of purchase. 42
(3) Each school board shall submit a report on the following 43
information to the State Board of Education by August 15 annually: 44
(a) The break/fix rate of the school technology devices 45
in the public school unit for the previous school year; 46

(b) The total number of school technology devices 47
currently in operation in the public school unit; 48
(c) The total number of school technology devices in 49
the public school unit requiring repair that, during the previous 50
school year, (i) underwent repair, or (ii) were no longer in 51
service; and 52
(d) The total amount of funds spent to repair or 53
replace school technology devices during the previous school year. 54
(4) The State Board of Education shall report to the 55
Legislature by November 15 annually on the break/fix rate of 56
school technology devices across all public school units based on 57
the reports submitted by the school boards in accordance with 58
subsection (3) of this section. This report shall include a 59
summary of the data reported by each school board and 60
recommendations to reduce break/fix rates in the future. 61
SECTION 2. This act shall take effect and be in force from 62
and after July 1, 2026. 63
