AN ACT TO AMEND SECTION 75-57-5, MISSISSIPPI CODE OF 1972, TO 1
CLARIFY THAT THE PROVISIONS OF THE LIQUEFIED COMPRESSED GAS 2
EQUIPMENT INSPECTION LAW IS APPLICABLE TO INSTALLERS OF SYSTEMS 3
AND APPLIANCES FOR END-USE RESIDENTIAL AND COMMERCIAL CUSTOMERS; 4
AND FOR RELATED PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. Section 75-57-5, Mississippi Code of 1972, is 7
amended as follows: 8
75-57-5. Unless the context otherwise requires, the 9
definitions which follow govern the construction and meanings of 10
the terms used in this chapter: 11
(a) "Liquefied compressed gas" means both liquefied 12
petroleum gas and anhydrous ammonia when the latter is used 13
exclusively for commercial fertilizer. For purposes of 14
application to this chapter, the term "liquified compressed gas" 15
shall also be construed to include natural gas and compressed 16
natural gas with regard to application of the term to installers 17
of systems and appliances for end-use residential and commercial 18
customers. 19

(b) "Liquefied petroleum gas" means any material having 20
a vapor pressure not exceeding that allowed for commercial 21
propane, composed predominantly of the following hydrocarbons, 22
either by themselves or as mixtures: propane, propylene, butane 23
(normal butane or isobutane) and butylene (including isomers). 24
(c) "Natural gas and compressed natural gas" means any 25
gaseous mixture containing primarily methane. 26
(d) "Anhydrous ammonia" means the compound formed by 27
the combination of the two (2) gaseous elements, nitrogen and 28
hydrogen, in the proportions of one (1) part of nitrogen to three 29
(3) parts of hydrogen by volume. Anhydrous ammonia is ammonia gas 30
in compressed and liquefied forms. It is not to be confused with 31
aqueous ammonia, which is a solution of ammonia gas in water. 32
Both liquefied petroleum gas and anhydrous ammonia are gaseous at 33
normal atmospheric temperatures and pressures but are readily 34
liquefiable by the application of moderate pressures. 35
(e) "Natural gas carburetion system" means any 36
compressed natural gas carburetion system. 37
(f) "Natural gas fueling system" means an assembly 38
consisting of compressors, containers, piping and other delivery 39
devices for the purpose of compressing natural gas for use as a 40
fuel in a motor vehicle and thereafter storing and/or dispensing 41
the compressed natural gas for such use. 42
(g) "Installer" means any person who has satisfactorily 43
passed an examination under the supervision of the Commissioner of 44

Insurance testing his knowledge and ability to install or repair 45
properly domestic systems, industrial systems, liquefied petroleum 46
gas carburetion systems, natural gas carburetion systems, bulk 47
plant systems, standby plant systems, anhydrous ammonia systems, 48
or other similar systems and who holds an installer's certificate 49
as provided in this chapter. 50
(h) "Container" means any vessel, including cylinders, 51
tanks, portable tanks and cargo tanks, used for the transporting 52
or storing of the liquefied compressed gases or compressed natural 53
gas, except containers which are subject to inspection under 54
federal laws or regulations. 55
(i) "Compressed gas" means any material or mixture 56
having in the container an absolute pressure exceeding forty (40) 57
pounds per square inch absolute at seventy (70) degrees Fahrenheit 58
or, regardless of the pressure, at seventy (70) degrees 59
Fahrenheit, having an absolute pressure exceeding one hundred four 60
(104) pounds per square inch absolute at one hundred thirty (130) 61
degrees Fahrenheit. 62
(j) "Flammable liquid" means any liquid having a closed 63
cup flash point below one hundred four (104) degrees Fahrenheit 64
and having a vapor pressure not exceeding forty (40) pounds per 65
square inch absolute at one hundred (100) degrees Fahrenheit. 66
(k) "Gas appliance" means any device which utilizes gas 67
to produce light, heat, power, refrigeration or air conditioning. 68

(l) "System" means an assembly consisting of one or 69
more containers with a means for conveying liquefied compressed 70
gas or compressed natural gas from the container or containers to 71
dispensing or consuming devices (either continuously or 72
intermittently) and which incorporates components intended to 73
achieve control of quantity, flow, pressure or state (either 74
liquid or vapor). Agricultural implements and commercial 75
installations used in refrigeration plants are excluded where 76
anhydrous ammonia is used. 77
(m) "Atmospheric pressure container" means any 78
container for the refrigerated storage of liquefied anhydrous 79
ammonia designed for a maximum working pressure of fifteen (15) 80
pounds per square inch gauge or less and having a water capacity 81
in excess of seven hundred thousand (700,000) gallons. 82
(n) "Distributor" means any person who is engaged in 83
the distribution of liquefied compressed gases, either wholesale 84
or retail. Also included under this definition are "commercial 85
carriers," as identified by the Interstate Commerce Commission, 86
who transport or haul liquefied compressed gases which are to be 87
distributed or sold within this state. 88
(o) "Person" means any individual, firm, partnership, 89
joint venture, association, corporation, estate, trust or any 90
other group or combination acting as a unit, and includes the 91
plural as well as the singular in number. "Person" shall include 92
husband or wife or both where joint benefits are derived from the 93

operation of a business or activity covered under this chapter. 94
"Person" shall include any state, county, municipality or other 95
agency engaged in a business or activity covered under this 96
chapter. 97
SECTION 2. This act shall take effect and be in force from 98
and after July 1, 2026. 99
