REGULATIONS NECESSARY TO IMPLEMENT THIS ACT; TO ESTABLISH THE 8
MISSISSIPPI GLACIER (ICE) GRANT PROGRAM FUND WITHIN THE STATE 9
TREASURY; AND FOR RELATED PURPOSES. 10
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 11
SECTION 1. (1) This act shall be known and may be cited as 12
the "Mississippi Glacier (ICE) Act." 13
(2) For the purpose of this section: 14
(a) "Law enforcement agency" means any agency or unit 15
of government or any municipality of the state or any political 16
subdivision thereof, or any agent thereof which has constitutional 17
or statutory authority to employ or appoint persons as officers, 18
whether such agency or unit has an internal investigation division 19
or not. The term also includes any private entity which has 20
contracted with the state or county for the operation and 21
maintenance of a nonjuvenile detention facility. 22

(b) "Partnership agreement" means that the law 23
enforcement agency that has submitted and gotten approval from the 24
United States Immigration and Customs Enforcement, under the 25
287(g) program, for the agency's Letter of Interest, and a signed 26
Memorandum of Agreement is entered into by both agencies. 27
(3) There is created in the Mississippi Department of Public 28
Safety the Mississippi Glacier (ICE) Grant Program to award grants 29
to support state and local law enforcement agencies in the 30
enforcement of federal immigration laws. Eligible grant 31
recipients must enter into a formal partnership agreement with the 32
United States Immigration and Customs Enforcement under the 287(g) 33
program. 34
(4) The department shall annually award any funds 35
specifically appropriated for the grant program to reimburse 36
expenses for, including, but not limited to, subletting detention 37
beds to the United States Immigration and Customs Enforcement, 38
equipment, travel, lodging, and training programs, which include 39
certified apprenticeship programs related to supporting the 40
enforcement of federal immigration laws. The total amount of 41
grants awarded may not exceed funding appropriated for the grant 42
program. 43
(5) The Department of Public Safety must promulgate the 44
rules and procedures governing the application and award process 45
for the grant program. Grants shall be awarded on a first-come, 46
first-served basis, based on the date the department received each 47

completed application. Consideration shall be given to whether 48
the law enforcement agency was a recipient of a grant under this 49
section in the previous year. 50
(6) In order to efficiently and effectively disburse the 51
funds, the department shall not duplicate benefits, and grants may 52
not be awarded to pay for any activity for which the agency has 53
received or expects to receive federal or other funding. 54
(7) The Department of Public Safety shall adopt rules and 55
regulations necessary to implement this act. 56
SECTION 2. There is created in the State Treasury a special 57
fund to be known as the "Mississippi Glacier (ICE) Grant Program 58
Fund," which may be established based on funds provided by the 59
State Legislature. Awards authorized under the Mississippi 60
Glacier (ICE) Grant Program shall be disbursed by the Mississippi 61
Department of Public Safety. The fund shall consist of monies 62
appropriated by the Legislature and funds received as grants, 63
endowments or gifts from the federal government, its agencies and 64
instrumentalities and funds from any other available sources, 65
public or private. Any unexpended monies remaining in the fund, 66
including interest thereon, at the end of each fiscal year, shall 67
not lapse to the State General Fund, but shall remain in the fund. 68
SECTION 3. This act shall take effect and be in force from 69
and after July 1, 2026. 70
