BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 17
SECTION 1. (1) The Department of Finance and 18
Administration, acting on behalf of the Mississippi Department of 19
Public Safety, may sell and convey or lease certain state-owned 20
real property used by and for the benefit of the Highway Safety 21
Patrol as its headquarters facility in Jackson, Mississippi, 22
provided that the sale and conveyance or lease is subject to the 23
conditions authorized in this section. The property being more 24
particularly described as follows: 25

A parcel of land and all the improvements located 26
thereon, situated at 1900 East Woodrow Wilson Avenue in 27
the City of Jackson, Hinds County, Mississippi, near the 28
intersection of Interstate 55 and Woodrow Wilson Avenue, 29
and containing 10.17 acres more or less: 30
BEGINNING W/S HWY 51 1728.43 FT SOUTH OF LAKELAND DR; 31
THENCE WEST 600 FT SOUTH 785.51 FT EASTERLY, 32
NORTHEASTERLY & NORTHWESTERLY ALONG HWY TO POINT OF 33
BEGINNING IN SOUTH 1/2 SOUTHEAST 1/4 OF SECTION 26, 34
TOWNSHIP 6, RANGE 1 EAST. 35
(2) The real property and improvements thereon, described in 36
subsection (1) of this section, shall, if sold, be sold for not 37
less than the current fair market value as determined by the 38
average of at least two (2) appraisals by qualified appraisers, 39
who shall be selected by the Department of Finance and 40
Administration and shall be certified and licensed by the 41
Mississippi Real Estate Appraisal Board. If the real property and 42
the improvements thereon, described in subsection (1) of this 43
section, are leased, the Department of Finance and Administration 44
is authorized to negotiate all aspects of any lease and any terms 45
and ancillary agreements pertaining to any lease as may be 46
reasonably necessary to effectuate the intent and purposes of this 47
section and to ensure a fair and equitable return to the state. 48

(3) All monies derived from the sale or lease of the 49
property authorized in this section shall be deposited into the 50
State General Fund. 51
(4) (a) The property described herein shall be sold or 52
leased to result in the highest and best use of the property, 53
provided that such redevelopment shall be designed and implemented 54
to include commercial, residential and/or retail space and to 55
preserve and enhance the existing educational, residential and 56
commercial integrity of the surrounding community. Such 57
redevelopment shall not include industrial purposes, adult 58
entertainment establishments, casinos, pawn shops or other gaming 59
establishments, liquor stores or solid waste facilities. If the 60
property described herein is sold, the deed conveyance shall 61
contain provisions to the effect of this paragraph (a) as a 62
reverter of the property. 63
(b) It is the intent of the Legislature that the 64
property will be sold or leased for the benefit of creating value 65
while also preserving the local environment and promoting growth 66
in the area. 67
(5) The Department of Finance and Administration shall 68
review and consider all proposals for purchase or lease of the 69
property described in subsection (1) of this section in light of 70
all factors which the department deems relevant, including, but 71
not limited to, the following: 72

(a) The proposed purchase price of the property or 73
rental payments, as applicable; 74
(b) The proposed use or uses of the property; 75
(c) The cost, scope and scale of any proposed 76
development and the amount of the investment to be made by the 77
proposed purchaser or lessee of the property; 78
(d) The projected impact of any proposed development on 79
the City of Jackson and the State of Mississippi, including 80
anticipated or projected tax revenue to be generated as a result; 81
and 82
(e) The projected timetable for any development. 83
(6) The State of Mississippi retains the exclusive right to 84
repurchase the property, if the property is sold under this act, 85
or to terminate the lease of the property, if the property is 86
leased under this act, if the purchaser or lessee, as applicable, 87
has not completed construction of more than fifty thousand 88
(50,000) square feet of improvements on the property consistent 89
with purposes as set forth in this section before December 31 of 90
the tenth year after the date of the sale or lease of the 91
property. The state may exercise its right to repurchase or 92
terminate the lease, which right shall be exercised within twelve 93
(12) months of the expiration of the above-referenced ten-year 94
period. The repurchase price for the property described in 95
subsection (1) of this section and the improvements thereon shall 96
be the fair market value at the time of repurchase as determined 97

by the average of at least two (2) appraisals by qualified 98
appraisers, who shall be selected by the Department of Finance and 99
Administration and shall be certified and licensed by the 100
Mississippi Real Estate Appraisal Board. If a lease created 101
according to this act is terminated, the provisions of the lease 102
shall control such process. 103
(7) The State of Mississippi shall retain all oil, gas and 104
mineral rights to the property sold or leased under this section. 105
(8) The Department of Finance and Administration may correct 106
any discrepancies in the legal description provided in subsection 107
(1) of this section. 108
SECTION 2. This act shall take effect and be in force from 109
and after its passage. 110
