SENATE BILL NO. 2352
AN ACT TO AMEND SECTION 21-19-49, MISSISSIPPI CODE OF 1972, 1
TO ALLOW MUNICIPALITIES, MUNICIPAL POLICE DEPARTMENTS, AND 2
SHERIFFS' DEPARTMENTS TO CONTRACT WITH THE SCHOOL BOARD OF 3
PRIVATE, NONPROFIT SCHOOLS TO PROVIDE CERTAIN SECURITY SERVICES; 4
AND FOR RELATED PURPOSES. 5
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 6
SECTION 1. Section 21-19-49, Mississippi Code of 1972, is 7
amended as follows: 8
21-19-49. (1) The governing authority of any municipality 9
or the board of supervisors of any county are hereby authorized 10
and empowered to appropriate money or dedicate and convey 11
municipally owned buildings and property or county-owned buildings 12
and property, as the case may be, to the school district or 13
districts situated within that municipality or county for the 14
purpose of erecting, purchasing or otherwise providing the school 15
building or a site for such school building of such school 16
district, in cases where the governing authority or board of 17
supervisors are of the opinion that the location of such school 18
building within the corporate limits of the municipality or the 19

county, or in close proximity thereto, will be of special benefit 20
to the inhabitants of the municipality or county. 21
(2) Municipalities, municipal police departments and the 22
sheriffs' departments may contract with the school board of any 23
school district, including private, nonprofit schools, to provide 24
additional Law Enforcement Officers Training Academy-certified 25
police protection to said school district on such terms and for 26
such reimbursement as the school district and the entity may agree 27
in their discretion. 28
(3) (a) The governing authority of any municipality or the 29
board of supervisors of any county may allow off-duty municipal or 30
county law enforcement officers who are hired individually for 31
security purposes by the school district or districts within that 32
municipality or county to use municipal or county law enforcement 33
uniforms and equipment, which includes vehicles, during such 34
off-duty employment. 35
(b) If the person or entity, and the person's or 36
entity's insurer, fails or refuses to endorse, indemnify and hold 37
harmless the employing jurisdiction, the employing jurisdiction 38
shall not approve the use of the official vehicle of the employing 39
jurisdiction for private security services. 40
(4) The governing authority of any municipality, in its 41
discretion, may donate funds, equipment or in-kind services to any 42
school district located within the boundaries of the municipality 43

to assist the voluntary character development or public service 44
programs of that school district. 45
SECTION 2. This act shall take effect and be in force from 46
and after July 1, 2026. 47
