SENATE BILL NO. 2384

AN ACT TO AMEND SECTION 83-17-59, MISSISSIPPI CODE OF 1972, 1
TO REQUIRE ANY TESTING SERVICE ADMINISTERING EXAMINATIONS FOR 2
INSURANCE PRODUCER LICENSE SHALL MEET STANDARDS OF THE NATIONAL 3
ASSOCIATION OF INSURANCE COMMISSIONERS; AND FOR RELATED PURPOSES. 4
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 5
SECTION 1. Section 83-17-59, Mississippi Code of 1972, is 6
amended as follows: 7
83-17-59. (1) A resident individual applying for an 8
insurance producer license shall pass a written examination unless 9
exempt under Section 83-17-67 or Section 83-17-39. The 10
examination shall test the knowledge of the individual concerning 11
the lines of authority for which application is made, the duties 12
and responsibilities of an insurance producer and the insurance 13
laws and regulations of this state. Examinations required by this 14
section shall be developed and conducted under rules and 15
regulations prescribed by the commissioner. 16
(2) The commissioner may make arrangements, including 17
contracting with an outside testing service, for administering 18
examinations and collecting a nonrefundable examination fee. Any 19

testing service under contract to administer examination services 20
as authorized by this subsection must develop, administer, and 21
score such examinations in accordance with the standards and best 22
practices developed and set forth by the National Association of 23
Insurance Commissioners. 24
(3) Each individual applying for an examination shall remit 25
a nonrefundable fee as prescribed by the commissioner. 26
(4) An individual who fails to appear for the examination as 27
scheduled or fails to pass the examination shall reapply for an 28
examination and remit all required fees and forms before being 29
rescheduled for another examination. 30
SECTION 2. This act shall take effect and be in force from 31
and after July 1, 2026. 32
