AN ACT TO BRING FORWARD SECTION 21-39-27, MISSISSIPPI CODE OF 1

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI: 5
SECTION 1. Section 21-39-27, Mississippi Code of 1972, is 6
brought forward as follows: 7
21-39-27. (1) The governing authority of any municipality 8
may acquire one or more credit cards which may be used by members 9
of the governing authority and municipal employees to pay expenses 10
incurred by them when traveling in or out of the state in the 11
performance of their official duties. The municipal clerk shall 12
maintain complete records of all credit card numbers and all 13
receipts and other documents relating to the use of such credit 14
cards. 15
(2) The members of the governing authority and municipal 16
employees shall furnish receipts for the use of such credit cards 17
each month to the municipal clerk who shall submit a written 18
report monthly to the governing authority. The report shall 19

include an itemized list of all expenditures and use of the credit 20
cards for the month, and such expenditures may be allowed for 21
payment by the municipality in the same manner as other items on 22
the claims docket. 23
(3) The issuance of a credit card to a member of the 24
governing authority or municipal employee under the provisions of 25
this section does not authorize the member of the governing 26
authority or municipal employee to use the credit card to make any 27
expenditure that is not otherwise authorized by law. Any member 28
of the governing authority or municipal employee who uses the 29
credit card to make an expenditure that is not approved for 30
payment by the governing authority shall be personally liable for 31
the expenditure and shall reimburse the municipality. 32
The employee shall be subject to all interest and fees and 33
other charges related to the collection of expenditures not 34
approved by the governing authority. 35
SECTION 2. This act shall take effect and be in force from 36
and after July 1, 2026. 37
